***RESOLUTION - Adopting the 34th Amendment to the Annual Appropriation Resolution No. 2023-185 to appropriate $632,400 for new capital improvement projects in the Public Works Department (citywide) (Subject to Mayor’s Veto) (Requires 5 Affirmative Votes).

RECOMMENDATION
Staff recommends that the City Council adopt the 34th Amendment to the Annual Appropriation Resolution No. 2023-185 to appropriate $632,400 for new capital improvement projects in the Public Works Department.
EXECUTIVE SUMMARY
There are several new capital improvement projects staff are preparing to implement which are funded from Federal grants, State grants, and other local sources. The grant funded projects were awarded Measure C Transit Oriented Development (TOD) funds through the Fresno Council of Governments, State funds through the Active Transportation Program (ATP) administered through the California Department of Transportation (Caltrans) and Federal transportation funds through the Highway Safety Improvement Program (HSIP) administered by the California Department of Transportation (Caltrans). Several projects are funded through the Measure “C” Regional Transportation Program. Staff recommends City Council adopt the amendment to the AAR in order to provide appropriations in the Public Works FY2024 Capital Budget to sufficiently cover anticipated expenditures for the cost of these new projects.
BACKGROUND
Staff is seeking Council approval on the attached AAR amendment which will appropriate funding for 10 new capital projects. The projects are funded via a combination of Federal funding, State funding, and other local funding with $632,400 of appropriations being requested for current FY2024 expenditures. The remaining project costs of $11,059,700 will be included in the proposed FY2025 capital improvement budget and generally include the construction phases of the projects.
Street Projects - This category consists of eight projects, with total appropriations requested for this category in the amount of $580,500:
• Cedar Ave Shields to Fountain Way Intersection Improvements was previously authorized by Council as part of Resolution 2022-197 for grant applications to Caltrans. $46,300.
• Ashlan & Shields Pedestrian Countdown Heads was previously authorized by Council as part of Resolution 2022-197 for grant applications to Caltrans. $14,400.
• Peach Ave Improvements SR180 to McKinley was authorized by Council as part of Cooperative agreements with the FCTA on February 1, 2024. $37,900.
• Peach Ave Widening Florence to Jensen authorized by Council as part of Cooperative agreements with the FCTA on February 1, 2024. $37,900.
• California Ave Enhancements Fruit to Pottle authorized by Council as part of Cooperative agreements with the FCTA on February 1, 2024. $37,900.
• McKinley Ave Repaving Chestnut to Peach is funded through Measure C Flexible funds. $50,100.
• Senior Activity Center TOD Housing Street Improvements was previously authorized by Council as part of Resolution 2023-041 for grant applications to the Fresno Council of Governments. $315,800.
• Ventura (Cesar Chavez Boulevard) TOD Affordable Housing Street Improvements was previously authorized by Council as part of Resolution 2023-041 for grant applications to the Fresno Council of Governments. $40,200.
Bicycle and Trail Projects - This category includes one project, Downtown Neighborhood Safe School Crossing which was previously authorized by the Council as part of Resolution 2022-134 for grant applications to Caltrans. Total appropriations requested for this category are $9,200.
Miscellaneous Projects - This category includes one project, West Shaw Ave TOD Planning Study which was previously authorized by the Council as part of Resolution 2023-041 for grant applications to the Fresno Council of Governments. Total appropriations requested for this project are $42,700.

ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a project as defined by the California Environmental Quality Act.
LOCAL PREFERENCE
Local preference does not apply to the projects included in this report as this is a rebudget item only. Local preference (if applicable) will be considered at the time of contract award.
FISCAL IMPACT
There is no new net fiscal impact to the General Fund. All proposed costs will be paid for from new and existing revenue sources. See attached Resolution for specific funds and associated costs.
