RECOMMENDATIONS

 

Staff recommends the City Council adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301(c) Class 1 of the CEQA Guidelines, award a construction contract with Dave Christian Construction Co., Inc., of Fresno, California, in the amount of $1,141,217 as the lowest responsive and responsible bidder for the Orange Avenue Pavement Overlay from California Avenue to Jensen Avenue, and authorize the Public Works Director or designee to sign a standardized contract on behalf of the City.

 

EXECUTIVE SUMMARY

 

Orange Avenue is in a state of disrepair due to its designation and use as an industrial truck corridor, extreme age, and significant weathering.  The recommended award of a construction contract for the Orange Avenue Overlay will include grinding and overlaying the existing travel lanes where the damaged paving is most pronounced and providing additional pavement thickness to the entire roadway section for an increased pavement strength and lifespan.  The Orange Avenue Overlay is a joint-agency project with participation from both the City of Fresno (49%) and the County of Fresno (51%).  Dave Christian Construction Co., Inc., submitted the low bid of $1,141,217 which was determined to be the lowest responsive and responsible bid on the project.

 

BACKGROUND

 

The Orange Avenue AC overlay from California Avenue to Jensen Avenue was initiated in FY15 when the City was awarded a Federal grant from the Regional Surface Transportation Program (RSTP).  The project was budgeted in the adopted FY16 Capital Budget by City Council and was designed by in-house Public Works staff once the grant funds were obligated.  Preliminary engineering design took approximately 14 months to complete.  No right-of-way acquisition was required for this project.

 

As a joint project with the County, both agencies worked collaboratively to prepare and execute a Cooperative Agreement which identified the financial and administrative obligations of both parties, as well as set thresholds for costs based on a mutually-agreed upon engineer's cost estimate.  This agreement was executed and approved by the County Board of Supervisors on April 3, 2018 and approved by City Council on April 5, 2018.

 

The scope of work for the Orange Avenue Pavement Overlay project includes limited areas of full-depth pavement replacement to address pavement failure, 0.2’ grind and overlay of the existing travel lanes and a 0.2’ conform grind at the gutters, as well as placing a 0.2’ overlay on the entire roadway within the project limits.  Other work includes constructing new curb ramps at Orange and Church Avenue and pavement restriping.

 

Public Works Staff prepared a “Notice Inviting Bids” which was published in the Fresno Business Journal on April 25, 2018, posted on the City’s website and faxed to 11 building exchanges.  The plans and specifications were distributed to 23 prospective bidders.  Four (4) sealed bid proposals were received and opened in a public bid opening held at City Hall on May 22, 2018; the bids ranged from $1,141,217 to $1,246,367. Dave Christian Construction Co., Inc. submitted the low bid of $1,141,217 and was determined to be the lowest responsive and responsible bid on the project.  The bids will expire on July 25, 2018, 64 days after the bid opening date.  If the bids are rejected or expire, the project will be rebid, resulting in a delay of approximately 60 days.

 

Staff recommends Council award a construction contract to Dave Christian Construction Co., of Fresno, California, in the amount of $1,141,217 for the Orange Avenue Pavement Overlay from California to Jensen Avenue as the lowest responsive and responsible bidder and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.

 

ENVIRONMENTAL FINDINGS

 

Staff has performed a preliminary environmental assessment of this project and has determined that it falls within the Categorical Exemption set forth in CEQA Guidelines Section 15301(c) (existing facilities), which exempts the repair, maintenance, or minor alteration of existing structures or facilities, including existing streets, sidewalk and gutters, with no further expansion of existing use. Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.

LOCAL PREFERENCE

 

Local preference was not implemented based on conditions of the federal funding for the project.

 

FISCAL IMPACT

 

The Orange Avenue AC overlay from California Avenue to Jensen Avenue is located in Council District 5.  The overall cost of the project is $1,422,438 with participation from the City and County as follows: City of Fresno: 49% and County of Fresno: 51%.  The City’s portion of the project is 100% federally funded by a Federal RSTP grant and the project will have no impact to the General Fund. The County is funding their portion of the project with local road funds.  Of the overall budget of the project, $1,141,217 will be used for the construction contract award.
