Title
Actions pertaining to professional On-Call Right of Way Consultant (Bid File 12501020) and Appraisal Services (Bid File 12500832) for the Capital Projects Department on City of Fresno capital improvement projects (Citywide):
1. Approve an On-Call Right of Way Consultant Agreement with Continental Acquisition Services, Inc., a California corporation DBA Continental Field Services of Fresno, California in the amount of $1,500,000.00;
2. Approve an On-Call Right of Way Consultant Agreement with Beacon Integrated Professional Resources, Inc., a California S-Corporation, DBA Hamner, Jewell & Associates of San Luis Obispo, California in the amount of $1,500,000.00;
3. Approve an On-Call Right of Way Consultant Agreement with Paragon Partners Consultants, Inc., a Delaware corporation of Cypress, California in the amount of $1,500,000.00;
4. Approve an On-Call Right of Way Consultant Agreement with Universal Field Services, Inc., an Oklahoma corporation of Fresno, California in the amount of $1,500,000.00;
5. Approve an On-Call Appraisal Consultant Agreement with CBRE, Inc., a Delaware corporation of Fresno, California in the amount of $1,500,000.00;
6. Approve an On-Call Appraisal Consultant Agreement with James G. Palmer Appraisals, Inc., a California corporation of Fresno, California in the amount of $1,500,000.00;
7. Approve an On-Call Appraisal Consultant Agreement with RPA Wakefield & Hopper, Inc., a California corporation DBA Real Property Analysts of Fresno, California in the amount of $1,500,000.00;

RECOMMENDATIONS
Staff recommends the City Council approve the four (4) On-Call Right of Way Consultant Agreements (ROW Agreements) and four (4) On-Call Appraisal Consultant Agreements (Appraisal Agreements) between the City of Fresno (City) and 1) Continental Acquisition Services, Inc., a California corporation DBA Continental Field Services (CFS), 2) Beacon Integrated Professional Resources, Inc., a California S-Corporation, DBA Hamner, Jewell & Associates (HJA), 3) Paragon Partners Consultants, Inc.(Paragon), 4) Universal Field Services, Inc. (UFS), 5) CBRE, Inc., a Delaware corporation (CBRE), 6) James G. Palmer Appraisals, Inc., a California corporation (JGPA), 7) RPA Wakefield & Hopper, Inc., a California corporation DBA Real Property Analysts (RPA), and 8) The Dore Group, Inc., a California corporation (TDG), collectively (Consultants) to provide professional Right of Way and Appraisal Consulting Services for Citywide capital improvement projects for a three-year term, to be reimbursed for hours worked at the hourly rates specified in the Schedule of Fees included in the Consultant’s respective agreement, not to exceed $1,500,000.00 over the entire term of the agreement for each Consultant, with no guarantee expressed or implied that the $1,500,000.00 will be authorized under any of the eight (8) respective agreements, and authorize the Capital Projects Director or designee to execute all eight agreements on behalf of the City.
EXECUTIVE SUMMARY
The Capital Projects Department (CPD) actively manages hundreds of the City’s capital improvement projects to deliver critical infrastructure improvements for other City departments such as Public Works, Public Utilities, Police, Fire, and PARCS. Due to the increase in project workload and the commonality of the improvements included in these projects, staff is recommending the proposed ROW Agreements and Appraisal Agreements as a solution to efficiently deliver these projects.
CPD staff have performed a qualification-based hiring process and have selected four right of way consultant firms and four appraisal consultant firms to perform these necessary services on an On-Call basis. Staff recommends Council approve the four ROW Agreements and the four Appraisal Agreements, each with three-year terms, no option to extend, and a total compensation not to exceed $1,500,000 individually to Continental Field Services, Hamner, Jewell & Associates, Paragon Partners Consultants, and Universal Field Services for Right of Way Consultant Services and CBRE, James G. Palmer Appraisals, Real Property Analysts, and the Dore Group for Appraisal Consultant Services. Upon approval and execution of the Agreements, projects will be identified, a Request for Proposal (mini-RFP) will be issued to all consultants for the services identified, and project by project Task Orders will be issued based on the most qualified consultant for each project. The funding for these services will come from different local, state, and federal funding sources for each individual task order.
BACKGROUND
Due to the number of projects tasked to the Real Estate Section of the Capital Administration Division by various City of Fresno departments, and the numerous parcel acquisitions for each, there is a need for On-Call Right of Way and Appraisal consultants to efficiently value and acquire property rights from private property. Hiring consultants to provide these services on a project-by-project basis is time consuming and creates project initiation delays.
The agreements for On-Call Right of Way and Appraisal Consulting Services will allow staff to deliver projects promptly and more efficiently. Each consultant’s proposed scope of services will vary on a project-by-project basis, varying from the valuation of property rights to the acquisition of the rights and potential relocation of the occupants of any residential or commercial property; activities which will augment City staff. These services are crucial for ensuring the high-quality construction of City capital projects. Individual projects will be identified based on the need for an appraisal or acquisition including appraisal, an initial scope of work developed, and will be issued to the selected On-Call consultants in the form of a mini-RFP. A task order will be issued to the most qualified consultant for a given project.
Staff recommends approval of the proposed agreements to improve efficiency and project timelines to perform Right of Way Consulting and Appraisal Services for the City’s capital projects. All funding necessary for the services of the proposed agreements will be appropriated under the individual capital projects for each individual task order.
In accordance with Administrative Order (A.O.) 6-19, staff sent out Request for Qualifications (RFQ) for professional Right of Way Consulting Services on October 21, 2024, via Planet Bids, email, and published in the Business Journal on October 23, 2024. RFQ for professional Appraisal Services was sent on October 8, 2024, via Planet Bids and email. At the closing of the advertisement period on November 15, 2024, the RFQ received four responses from Right of Way Consultants and at the closing on November 7, 2024, four responses from Appraisal Consultants. City staff evaluated each Statement of Qualifications (SOQ) and determined all satisfied the requirements of the RFQ. The four Right of Way Consultant SOQs were evaluated and ranked, and the four Appraisal Consultant SOQs were evaluated and ranked. At the conclusion of the evaluation period, Continental Field Services, Hamner, Jewell, & Associates, Paragon Partners Consultants, and Universal Field Services were selected as consultants for Right of Way Services, and CBRE, James G. Palmer Appraisals, Real Property Analysts and The Dore Group were selected as consultants for Appraisal Services.

Palmer Appraisals, 3) Real Property Analysts, and 4) The Dore Group for Appraisal Services, each with three-year terms and a total compensation amount not to exceed $1,500,000 individually, with no guarantee expressed or implied that $1,500,000 will be authorized under any respective agreement, to provide various Right of Way and Appraisal Services for the Capital Projects Department on City capital projects, and authorize the Capital Projects Director or designee to execute the agreements.
The City Attorney’s Office has reviewed and approved these agreements as to form.
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, the award of these contracts does not qualify as a “project.”
LOCAL PREFERENCE
Local preference was not implemented for this consultant selection process due to federal funding sources that will be attributed to projects under the agreements.
FISCAL IMPACT
These agreements have no immediate impact to the General Fund and the agreements will service projects Citywide. All funding necessary for the services of the proposed agreements will be appropriated under the individual capital projects for each individual task order.
