Approve Third Amendment to Agreement with Carollo Engineers, Inc., in the amount of $18,170 utilizing project contingencies for minor design modifications of the City of Fresno’s 80-Million Gallon Per Day Southeast Surface Water Treatment Facility and Authorize the Director of Public Utilities or designee, to sign the Amendment on behalf of the City of Fresno (citywide).

RECOMMENDATIONS
Staff recommends that City Council:
1. Approve the Third Amendment to the Professional Engineering Consultant Services Agreement with Carollo Engineers, Inc., increasing the fee amount by $18,170 for a Total Fee amount of $9,445,637, and reduce the contingency amount to $545,363, for additional professional design services.
2. Authorize the Director of Public Utilities, or designee, to sign the Amendment on behalf of the City of Fresno.
EXECUTIVE SUMMARY
This Third Amendment to the professional engineering contract with Carollo Engineers, Inc., for the design of the City of Fresno’s (City’s) 80-million gallon per day (80 MGD) Southeast Surface Water Treatment Facility (SESWTF) provides services for minor water line infrastructure modifications that include agency coordination, surveying and design required to complete the construction documents. These additional services will be funded using a portion of the Project’s Design Contingency Fund, leaving a remaining contingency balance of $545,363 for the project. With the execution of Amendment No. 3, the design portion of the SESWTF Project will be 100-percent complete, and no further amendments for design services for the SESWTF will be required for the project.
BACKGROUND
On June 24, 2013, and upon Council approval, the City entered into a professional engineering design consultant Agreement with Carollo Engineering Inc., for the design of the City’s 80 MGD SESWTF. The contract was approved for a Total Fee of $9,991,000, which included a Base Fee of $9,149,600 and Design Contingency Fund of $841,400.
On July 21, 2014, Council approved the First Amendment to the Agreement to provide design services for an electrical substation to serve the SESWTF. The value of First Amendment was $225,000, and the costs were funded from the Design Contingency Fund.
On August 24, 2014, Council approved the Second Amendment to the Agreement to provide design services for the Kings River Raw Water Pipeline for the SESWTF. The value of Second Amendment was $52,867, and the costs were funded from the Design Contingency Fund.
Amendment No. 3 will provide services for additional agency coordination, surveying and design required to complete the 100-percent construction documents for the SESWTF. The value of Amendment No. 3 is $18,170, and the costs will be funded from the Design Contingency Fund.
With the execution of Amendment No. 3, the design portion of the SESWTF Project will be 100-percent complete, and no further design service amendments will be required for the SESWTF project and no additional Design Contingency Funds will be required for the project. The final remaining balance of the Design Contingency Fund is $545,363, and the design portion of the SESWTF Project was completed for less than originally anticipated with the contingency fund.
This Third Amendment has been approved as to form by the City Attorney’s Office.
ENVIRONMENTAL FINDINGS
Adoption of this Third Amendment is not a “project” for the purposes of California Environmental Quality Act (CEQA), as it is a funding mechanism or other government fiscal activity, and does not involve commitment to any specific project which may result in a potentially significant physical impact on the environment as contemplated by CEQA Guidelines Section 15378(b).
LOCAL PREFERENCE
The local preference was not implemented because this is not a competitive bid award.
FISCAL IMPACT
There is no impact to the General Fund. This Third Amendment utilizes project contingencies previously encumbered as outlined in the five-year utility rate plan that was adopted by the City Council on February 26, 2015.
