Title
Approve the First Amendment to the Consultant Services Agreement between the City of Fresno (City) and GHD, Inc., (Consultant) for Environmental Consultant and Cleanup Services for 1457 H Street Cleanup (Project), to extend the original Agreement term from March 20, 2026, to October 7, 2027, in alignment with the grant operation period.

RECOMMENDATION
Staff recommend City Council approve the First Amendment to the Agreement to extend the term of the Agreement through October 7, 2027, aligning with the grant operation period. This extension will allow the Consultant to continue providing services necessary for the successful completion of the grant funded activities for the Project.
EXECUTIVE SUMMARY
Staff recommend that the City Council approve the First Amendment to the Consultant Services Agreement with the Consultant to extend the term through October 7, 2027. This extension aligns with the grant operation period and ensures continued support for the successful implementation of the Equitable Community Revitalization Grant (ECRG) program and ensures continuity of services and compliance with grant requirements for the Project. This amendment is only an extension in term, not compensation.
BACKGROUND
The California Department of Toxic Substances Control (DTSC) issued an Equitable Community Revitalization Grant (ECRG) Round 2 Guidelines soliciting applications on August 14, 2023, to implement the Cleanup in Vulnerable Communities Initiative under Senate Bill 158 (Chapter 73, Statutes of 2021) allocating $500 million to DTSC to expedite the cleanup and beneficial reuse of contaminated properties, with priority given to properties in historically vulnerable and disadvantaged communities. There is approximately $85 million available for funding through Round 2 of the ECRG application, which closes on October 9, 2023. The City of Fresno (City) is an eligible entity and intends to apply for up to $10 million to facilitate the remediation of City-owned property located at 1457 H Street (Site), to allow for revitalizing reuse of the Site.
On October 5, 2023, Council approved Resolution No. 2023-268 authorizing staff to apply for ECRG Round 2 funding.
On April 18, 2024, Council approved Resolution No. 2024-078 accepting $3,122,648 in ECRG Round 2 grant funds for the cleanup and remediation of the 1457 H Street site.
On December 12, 2024, Council approved the Standard Agreement for the Consultant and Cleanup Services between the City and Consultant for an amount not to exceed $2,157,000 for activities associated with site assessment and remediation with a term ending on March 20, 2026.
On August 12, 2025, DTSC opened the ECRG Round 2 Amendment 1 Grant Term Extension application, allowing grantees to request an extension of the grant term through October 7, 2027.
On November 14, 2025, DTSC approved the City’s request to extend the grant term through October 7, 2027, ensuring sufficient time to complete the remediation activities at the site.
The extension to the Agreement with the Consultant team is critical to allow the Consultant to continue providing services necessary for the successful completion of the grant-funded remediation activities of the Project. Staff recommends that the City Council approve the First Amendment to the Agreement.
ENVIRONMENTAL FINDINGS
The proposed First Amendment to the Agreement is not a project under the California Environmental Quality Act (CEQA) pursuant to Section 15378 therefore, is exempt from CEQA requirements.
LOCAL PREFERENCE
Local preference is not applicable because of the use of state funds.
FISCAL IMPACT
There is no impact on the City’s General Fund as a result of this action. Funds used for this Agreement come completely from the ECRG Grant previously awarded to the City.
