Approve the First Amendment to the Consultant Services Agreement with Brooks-Ransom Associates, Inc., in the amount of $52,500.00, bringing the total contract to $108,900.00, with no remaining contingency to provide additional professional engineering services needed to perform structural inspections, develop recommendations for permanent repairs and complete construction documents for the City of Fresno Garage 8 High Priority Repairs Project (Council District 3)

RECOMMENDATION
Staff recommends the City Council approve the First Amendment to the Consultant Services Agreement with Brooks-Ransom Associates, Inc., in the amount of $52,500.00, bringing the total contract amount to $108,900.00 with no remaining contingency and authorize the Capital Projects Director, or designee, to execute the First Amendment on behalf of the City of Fresno (City) to provide the additional professional engineering services needed to perform structural inspections, develop recommendations for permanent repairs and complete construction documents for the City of Fresno Garage 8 (Underground) High Priority Repairs Project.
EXECUTIVE SUMMARY
On June 25th, 2018, a contract was awarded in the amount of $56,400 to Brooks-Ransom Associates, Inc., for the City of Fresno Parking Garage 8 High Priority Repairs Project to prepare complete construction documents for the high priority repairs identified by the Walter P. Moore Condition Assessment Report (Report) completed in 2016 for the structure. The proposed City of Fresno Parking Garage 8 High Priority Repairs Project includes repairs to existing concrete ceiling and floor decks, walls, stairs, and installation of new safety bollards around stairs and elevators. These repairs were intended to maintain and provide public safety improvements that shall extend the parking structure’s lifespan.
During the construction phase of these repairs, it was determined that additional professional engineering services are required beyond what was authorized in the original Consultant Services Agreement. This First Amendment to the Consultant Services Agreement will allow for additional design services to perform structural inspections, develop recommendations, and prepare permanent repair plans. This First Amendment will be funded by Fiscal Year 2026 General Services Department Facilities Management Budget appropriations.
BACKGROUND
The City of Fresno Garage 8 is located at 1077 Van Ness Avenue, Fresno CA 93721. This facility provides 968 total parking stalls that are used for both monthly and daily parking for downtown Fresno. The three-level underground structure is located on the corner of Van Ness Avenue and Tulare Street. The parking garage provides optimal parking for several businesses in the surrounding area. The structure was built in 1966 and there are several elements within the structure that need repair to maintain a safe operation for vehicles and pedestrians alike. The elements within the structure that require repair were identified by the Report completed in 2016 for the structure which includes repairs to existing concrete ceiling and floor decks, walls, stairs, and installation of new safety bollards around stairs and elevators.
On June 25th, 2018, a contract was awarded in the amount of $56,400 to Brooks-Ransom Associates, Inc., for the City of Fresno Parking Garage 8 High Priority Repairs Project to prepare complete construction documents for the high priority repairs identified by the Report. On June 26, 2025, a contract was awarded in the amount of $945,288 to Ashron Construction and Restoration, Inc., of Galt, California to complete the Garage 8 High Priority Repairs Project. However, during construction phase administration and coordination of these repairs, it was determined that additional professional engineering services are required beyond what was authorized in the original Consultant Services Agreement. Unforeseen construction issues resulted in identification of post-tensioned cable failures both within the Green Level (Upper Level) and Blue Level (Mid-Level) of the structure and additional full depth concrete repair requirements at the southern wing of the Green Level (Upper Level). These were identified because of the removal of structural concrete sections within the garage as part of the original scope of repair work for the Project. Additionally, concrete spalls that were not identified in the Report but were identified during construction, now require immediate remediations. To address these needs, the City proposes a First Amendment to expand the scope of work accordingly.
Staff now recommends approval of the First Amendment to the Consultant Services Agreement to increase the contract amount by $52,500.00, increasing the total contract to $108,900.00, with no remaining contingency, and authorize the Capital Projects Director, or designee, to sign on behalf of the City. This First Amendment will provide the additional professional engineering services needed to perform structural inspections, develop recommendations for permanent repairs, and complete construction documents for the City of Fresno Garage 8 High Priority Repairs Project.
The City Attorney’s Office has reviewed and approved the proposed First Amendment as to form.
ENVIRONMENTAL FINDINGS
Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, the Amendment of this Consultant Services Agreement for design services does not qualify as a “project” for the purpose of CEQA.
LOCAL PREFERENCE
Local preference does not apply to this action because this is an Amendment to an existing Consultant Services Agreement.
FISCAL IMPACT
The Project is located in Council District 3 and will have no impact to the General Fund. Funding for this Project is included in the Fiscal Year 2026 General Services Department Facilities Management Budget.
