RECOMMENDATION

 

Staff recommends that City Council approve the Second Amendment to the Consultant Services Agreement (Agreement) with Michael K. Nunley & Associates, Inc., (Consultant), to increase the total contract by an amount not to exceed $126,754.00, with an additional contingency amount not to exceed $19,013.00, for a revised total contract amount not to exceed $229,277.00 and a revised contingency amount not to exceed $34,392.00, to expand the Consultant’s scope of services, and to extend the term of the Agreement to December 31, 2027, for the Design of Booster Pump Replacements at Pump Stations 89A, 150, and 176 Project (Project); and authorize the Capital Projects Director or designee to sign and execute all documents on behalf of the City of Fresno (City).

 

EXECUTIVE SUMMARY

 

On June 10, 2022, the City approved a Consultant Services Agreement with Michael K. Nunley & Associates, Inc., to provide engineering design services for the Project. The original scope of services included the design of replacement booster pumps at three (3) separate pump station locations within the City. Following execution of the original Agreement, an extensive review of site requirements necessitated the need to enter into the First Amendment to the Consultant Services Agreement dated December 16, 2024. The First Amendment extended the term of the Agreement and replaced improvements originally planned at Pump Station 133 with Pump Station 176 without changing the overall compensation of the original Agreement.

 

Staff now recommends approval of the Second Amendment to the Consultant Services Agreement to design an aeration system at Pump Station 89A and a new blower and appurtenances at Pump Station 150, and to extend the term of the Agreement to December 31, 2027.  The Second Amendment to the Agreement will be funded utilizing appropriations included in the Fiscal Year 2026 Capital Improvement Budget within the Water Enterprise Fund.

 

BACKGROUND

 

When the City’s Northeast Surface Water Treatment Facility (NESWTF) was put into operation in 2004, it was known that water pressure within the water distribution system would change. The City currently makes use of well water to supplement the output of the NESWTF during high water demand periods. The current booster pumps at many of the City’s pump stations are not sufficient to meet the new water distribution system pressures. This Project is the first of several to replace booster pumps that will allow the City to continue to meet demands during high water usage periods.

 

On June 10, 2022, the City and the Consultant entered into an Agreement for an amount not to exceed $102,523.00 paid on a time and materials basis, with a contingency amount not to exceed $15,379.00, for professional engineering services for the design of the Project. The original scope of work included the design of removing the existing split case booster pump and replacing it with a vertical turbine (can-mounted) pump, suction and discharge piping, and associated flow and pressure-measurement instrumentation for Pump Stations 89A, 133, and 150.  Additionally, each pump was to be equipped with a variable frequency drive (VFD).

 

Following execution of the Agreement with Michael K. Nunley & Associates, Inc., the City performed an extensive review of the various sites and their requirements. During this time, the original Agreement was approaching the contract expiration date, so the City and Consultant agreed to enter into the First Amendment to the Consultant Services Agreement dated December 16, 2024. The First Amendment extended the term of the original Agreement to October 31, 2026, to allow completion of the original scope of services. Additionally, the First Amendment replaced Pump Station 133 improvements with similar improvements at Pump Station 176 without changing the overall compensation of the Agreement. 

 

Staff now recommends approval of the Second Amendment to the Consultant Services Agreement to extend the term of the Agreement to December 31, 2027 and increase the total contract by an amount not to exceed $126,754.00 and increase contingency by an amount not to exceed $19,013.00, increasing the total contract to an amount not to exceed $229,277.00 with a revised contingency amount not to exceed $34,392.00, paid on a time and materials basis in accordance with the Consultant’s updated schedule of fees, and authorization of the Capital Projects Director or designee to sign the Second Amendment on behalf of the City. At the request of the Department of Public Utilities, this Second Amendment includes work to design an aeration system at Pump Station 89A and a new blower at Pump Station 150. The scope of work will also include the development of additional site plans and specifications. The Department of Public Utilities has identified these improvements as being critical to the pump station’s ability to produce high quality potable water. The Second Amendment to the Agreement will be funded utilizing appropriations included in the Fiscal Year 2026 Capital Improvement Budget within the Water Enterprise Fund. 

 

The City Attorney’s Office has reviewed and approved the proposed Amendment as to form.

 

ENVIRONMENTAL FINDINGS

 

Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, the Amendment of this Consultant Services agreement for design services does not qualify as a “project” for the purpose of CEQA.

 

LOCAL PREFERENCE

 

Local preference does not apply to this action because this is an amendment to an existing consultant services agreement.

 

FISCAL IMPACT

 

The proposed Project is located in Council District 6 and has no impact to the General Fund. Funding for this Project is included in the Fiscal Year 2026 Capital Improvement Budget within the Water Enterprise Fund.
