RECOMMENDATION

 

It is recommended that Council adopt the Fifteenth Amendment to the Fiscal Year 2026 Salary Resolution No. 2025-177 to add the new classification of Special Assistant City Attorney and the respective E5 salary range in addition to retitling the Environmental Control Officer to Environmental Compliance Inspector, effective December 1, 2025.

 

EXECUTIVE SUMMARY

 

The new Special Assistant City Attorney classification is recommended to be added to the Salary Resolution in order to appropriately classify attorneys performing legal work at the Assistant City Attorney level but who do not exercise supervisory duties of subordinate staff.

 

The existing Environmental Control Officer classification is recommended to be retitled to Environmental Compliance Inspector to be consistent with industry standards and accurately reflect the duties and responsibilities performed.

 

The City provided notice to the respective bargaining units and has met its meet and confer obligation.

This action will not require additional appropriations.

 

BACKGROUND

 

New Special Assistant City Attorney classification

With expansion of the City Attorney’s Office, the Assistant City Attorney classification does not accurately reflect the duties and responsibilities of all Assistant City Attorneys. While many Assistant City Attorneys have supervisory duties, some do not. Nevertheless, both groups perform high-level, complex legal work, consistent with the experience required for the Assistant City Attorney classification.

 

The City Attorney’s Office wishes to recognize the distinction between supervising Assistant City Attorneys and non-supervising Assistant City Attorneys, recognizing that supervisory duties add significant additional responsibilities on top of the complex, high-level legal work expected of all Assistants.

 

Therefore, the new classification of Special Assistant City Attorney will appropriately classify those attorneys performing legal work at the Assistant level, but who do not exercise supervisory duties of subordinate staff.

 

Retitle of the Environmental Control Officer classification

 

The Environmental Control Officer classification is focused on ensuring compliance with Publicly Owned Treatment Works, Industrial Pretreatment Program, wastewater discharge permits, and other federal, state, and local requirements.  Retitling this classification to Environmental Compliance Inspector (ECI) is recommended to be consistent with industry standards including the ECI certification program offered by the California Water Environment Association and accurately reflects the duties and responsibilities performed that are focused on compliance rather than control.

 

The City provided notice to the respective bargaining units and has met its meet and confer obligation.

 

The City Attorney’s Office has approved the Fifteenth Amendment to Salary Resolution No. 2025-177 as to form.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act Guidelines (CEQA) Section 15378, this item does not qualify as a “project” and is therefore exempt from CEQA.

 

LOCAL PREFERENCE

 

Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno.

 

FISCAL IMPACT

 

The amendment will not require any additional appropriations for Fiscal Year 2026.
