Approve the Second Amendment to the Professional Engineering Services Agreement with Quad Knopf, Inc, dba QK in the amount of $15,000, increasing the total contract amount to $83,400 with a remaining contingency of $500, due to increased scope of services for the Fink-White Park Splash Pad Project (Council District 3).

RECOMMENDATION
Staff recommends City Council approve the Second Amendment to the Professional Engineering Services Agreement with Quad Knopf, Inc, dba QK in the amount of $15,000, increasing the total contract amount to $83,400, with a remaining contingency of $500, for design and construction support services related to underground utility infrastructure identified during the construction and installation of the new splash pad equipment and authorize the Capital Projects Director or designee to execute the Second Amendment on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The City of Fresno awarded a contract for construction on December 15, 2022, for the Fink-White Park Splash Pad Project, located at 535 South Trinity Street. During the demolition work process, the contractor discovered unforeseen underground utilities not identified in the original approved construction plans. The underground utilities included electrical lines, water lines, and a concrete foundation, not reflected on City as-built records. QK provided recommendations to revise the construction plans based on field measurements and additional topographic survey. Staff recommends the approval of the Second Amendment to the Professional Engineering Services Agreement with Quad Knopf for the necessary redesign to address existing underground utilities. This project was funded by Community Development Block Grant (CDBG) funds. The additional scope of work will be funded by Measure P, Category 1 funds appropriated with the FY24 Annual Appropriations Resolution.
BACKGROUND
The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) has initiated a project to replace the existing wader pool at Fink-White Park with a splash pad, which was requested through extensive community input. On September 19, 2019, Council approved the Consultant agreement between the City and Quad Knopf, Inc which included the following scope of work: develop plans for a themed splash pad with dumping features and spray amenities, provide cost estimates, specifications, bidding, and construction support services. Services also included obtaining approvals from the City Building & Safety Division and County Health Department. After completing the design, the project was bid, and a construction contract was awarded to American Paving Company on December 15, 2022. Following the award, the contractor worked on providing the necessary contract documents and material submittals to start construction. Several of the materials, such as the Splash Pad Sprays, UV Sanitation System and the Metal Roof Shade Structure, were long lead items that delayed the official notice to proceed and start of construction.
A notice to proceed was issued to American Paving Company on October 10, 2023, and during demolition, underground utilities and a concrete foundation were discovered in conflict with the new construction, which were not identified on existing City as-built records and therefore not incorporated into the design. To continue the construction of the splash pad project at Fink White with minimal impact to the construction schedule, staff recommends approving the Second Amendment to accommodate the additional scope of work needed to incorporate the existing utilities within the design of the new amenity.
The original Consultant Services Agreement dated September 19, 2019, allocated a total amount of $62,600 with a contingency amount of $6,300. The First Amendment to the original Consultant Services Agreement dated March 22, 2021, utilized a portion of the available contingency of $5,800 to include additional structural engineering and design.
Staff now recommends approval of the Second Amendment to the Professional Engineering Services Agreement with Quad Knopf, Inc in the amount of $15,000, increasing the total contract to $83,400, with a remaining contingency of $500, to accommodate the additional scope of work needed to incorporate the existing utilities at the project site within the design of the new amenity and authorize the Capital Projects Director or designee to execute the second amendment to the original agreement on behalf of the City.
ENVIRONMENTAL FINDINGS
Contract amendment does not qualify as a project pursuant to California Environment Quality Act (CEQA) Guidelines § 15378.
LOCAL PREFERENCE
Quad Knopf, Inc is a local business, as defined by the Fresno Municipal Code.
FISCAL IMPACT
The project is in Council District 3. This project was funded by Community Development Block Grant (CDBG) funds. The additional scope of work with will funded by Measure P, Category 1 funds appropriated with the FY24 Annual Appropriations Resolution.
