RECOMMENDATION

 

Staff recommends the City Council award a construction contract with Yarbs Grading and Paving Inc., of Fowler, California, in the amount of $6,860,785.12 as the lowest responsive and responsible bidder and authorize the Capital Projects Director or designee to sign the construction contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The Capital Projects and Public Works Departments seek to award a construction contract for the MLK Center Active Transportation Project. The improvements will provide essential multimodal options for the college and surrounding area. This project plans to construct essential bicycle and pedestrian infrastructure around the new State Center Community College District’s (SCCCD) West Fresno Campus and proposed West Creek Village development in Southwest Fresno. The MLK Center Active Transportation Project improvements include a Class I trail, Class II bike lanes, pavement rehabilitation, sidewalk, curb & gutter, street lighting, traffic signal modifications, and Americans with Disabilities Act (ADA) compliant curb ramps. This project is funded by a federal Congestion Mitigation and Air Quality (CMAQ) grant, Measure C bike and trail funds and local Senate Bill 1 (SB1) Road Maintenance and Rehabilitation Account (RMRA) funds.

 

BACKGROUND

 

The City Council approved a Development Agreement for the West Creek Village development, and the State Center Community College District has recently opened a new campus in southwest Fresno. The boundaries of these proposed projects are Martin Luther King Jr. Boulevard, Jensen Avenue, Walnut Avenue, and Church Avenue. The MLK Center Active Transportation Project will provide essential bicycle and pedestrian infrastructure around the campus including a Class I trail, Class II bike lanes, sidewalk, curb and gutter, pavement rehabilitation, traffic signal modifications, and Americans with Disabilities Act (ADA) compliant curb ramps. The City was awarded a CMAQ Program grant in 2017 to fund professional engineering and construction of these improvements which was complemented with SB1 Road Maintenance and Rehabilitation Program funding. The design started following the City Council approval of the consultant contract with Mark Thomas & Company, Inc., of Fresno, California, on June 11, 2020.

 

The Notice Inviting Bids was published in the Business Journal on July 5, 2024, and posted on the City’s website. Five sealed bid proposals were received and opened in the public bid opening on August 13, 2024, with bids ranging from $6,860,785.12 to $7,864,051.10. Yarbs Grading and Paving Inc. of Fowler, California is deemed the lowest responsive and responsible bidder. The bids will expire 64 days after the bid opening, on October 16, 2024. If the bids are rejected or expire, the project will be rebid resulting in a delay of approximately 3 months.

 

This contract is covered by the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement to Be Bound.

 

Staff is recommending the award of a construction contract for the MLK Center Active Transportation Project to Yarbs Grading and Paving Inc., of Fowler, California, in the amount of $6,860,785.12, as the lowest responsive and responsible bidder, and to authorize the Capital Projects Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.


The City Attorney’s Office has reviewed and approved the construction contract as to form.

 

ENVIRONMENTAL FINDINGS

 

This project was determined to be Categorically Exempt under Section 15301/Class 1, 15303/Class 3, and 15304/Class 4 of the California Environmental Quality Act (CEQA) Guidelines, which was previously adopted by City Council on March 9, 2023.

 

LOCAL PREFERENCE

 

Local preference is not applicable due to the Federal funding requirements.

 

FISCAL IMPACT

 

The MLK Center Active Transportation Project is located in Council District 3. The overall cost of the project is $9,117,560 and is funded by a federal CMAQ grant, Measure C bike and trail, and local SB1 Road Maintenance and Rehabilitation Account (RMRA) funds. Of the overall budget of the project, $6,860,785.12 will be used for the construction contract award. The project will have no impact to the General Fund. All funds necessary for the contract award are included in the adopted fiscal year budget.
