***BILL-15 - (Intro’d June 13, 2024) (For Adoption) - Repealing Section 7-1221, Section 7-1222, Section 7-1237, and Section 7-1238, and Amending Section 7-1233 of the Fresno Municipal Code, Relating to Outdated Provisions Concerning Various Business License Fees (Subject to Mayor’s Veto).

RECOMMENDATION
Staff recommends that City Council adopt proposed ordinance to repeal Sections 7-1221, 7-1222, 7-1237, and Section 7-1238, and amend Section 7-1233 of the Fresno Municipal Code, relating to outdated provisions concerning various business licenses.
EXECUTIVE SUMMARY
The Finance Department requests adoption of the proposed ordinance for the following FMC removals and revisions:
• 7-1221 - Exhibitor of Feats of Chance or Skill
• 7-1222 - Manager of Merry Go-Rounds and Similar Amusement of Devices
• 7-1237 - Manager of Boxing and Wrestling Matches
• 7-1238 - Museum Manager, from the Fresno Municipal Code
Amendment to Section 7-1233 by replacing the word ‘Bootblack’ with ‘Shoeshine’ as bootblack is an outdated and unused business term.
The adoption of this ordinance will ensure clarity and alignment between the Fresno Municipal Code and the Master Fee Schedule. On February 1, 2024, the City Council adopted Resolution 2024-016 removing from or otherwise revising business license fees associated with these businesses in the Master Fee Schedule.
BACKGROUND
During the FY25 Master Fee Schedule revision process, the Finance Department submitted changes and updates to the department’s Master Fee Schedule for FY2025. These changes included updates to specific business tax fees with deletions and revisions for businesses and professions that were deemed outdated and/or no longer existed. In February 2024, City Council adopted Resolution 2024-016 to accept these updates and they will be removed from the Master Fee Schedule effective July 1, 2024.
With the adoption of Resolution 2024-016, certain references remain in the Fresno Municipal Code that are associated with these Master Fee Schedule deletions and revisions. This ordinance will ensure consistent information and definitions between the Fresno Municipal Code and the Master Fee Schedule. Approval of this ordinance will remove and update FMC Codes as noted above in the Executive Summary and detailed in the proposed ordinance.
ENVIRONMENTAL FINDINGS
Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, this item is not a project for the purposes of CEQA.
LOCAL PREFERENCE
Local preference was not implemented as this does not involve the bid or award of a construction or services contract.
FISCAL IMPACT
There will be no fiscal impact. All fees deleted or revised herein are no longer in use or outdated according as adopted in Resolution 2024-016.
