RECOMMENDATION
Staff recommends that the City Council adopt a finding of Categorical Exemption per staff determination, pursuant to Section 15301(d)/Class1 and 15302/Class 2 of the California Environmental Quality Act (CEQA) Guidelines and award a construction contract to American Paving Company of Fresno, California, in the amount of $1,271,280 as the lowest responsive and responsible bidder and authorize the Public Works Director or designee to sign the standardized contract on behalf of the City.
EXECUTIVE SUMMARY
The City of Fresno Parks, After School, Recreation and Community Services (PARCS) Department seeks to construct a splash play area at Fink-White Park located on the northeast corner of South Trinity Street and East Whitesbridge Avenue. The scope of work includes removing the existing wader pool and constructing a splash play area and associated utility and accessible path improvements. Awarding a construction contract for this project will allow the Department to replace the unused, decommissioned wader pool with a splash play area that will improve the park’s appeal and service to youth and families during warm weather and increase community pride and investment in the park. The project is fully funded with Community Development Block Grant (CDBG) funds and Measure P revenues.
BACKGROUND
The Fink-White Park Splash Play Area Project was awarded CDBG funding through the City of Fresno 2018-2019 Annual Action Plan for U.S. Department of Housing and Urban Development Community Planning and Development Programs. Project design began following the execution of the consultant agreement with Quad Knopf, Inc. dba QK, on September 30, 2019.
The Notice Inviting Bids was advertised and published in the Business Journal on September 16, 2022 and posted on the City’s website. Eleven (11) building exchanges received the Notice Inviting Bids. The specifications were distributed to twenty-three (23) prospective bidders. Only one (1) sealed bid proposal was received and opened in a public bid opening on November 1, 2022, in the amount of $1,271,280.
Staff is recommending that City Council award a construction contract to American Paving Company of Fresno, California, in the amount of $1,271,280 to construct the Fink-White Splash Play Area, as the lowest responsive and responsible bidder, and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.
The Community Workforce Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this project was less than $1 million, pursuant to the terms of the PLA.
The City Attorney’s Office has reviewed and approved as to form.
ENVIRONMENTAL FINDINGS
Staff performed a preliminary environmental assessment of this project and determined that it falls within the Categorical Exemption set forth in CEQA guidelines, Section 15301(d)/Class 1 (Existing Facilities) and 15302/Class 2 because the project includes no expansion of an existing use.
LOCAL PREFERENCE
Local preference was not implemented for this project due to it being funded through a Federal Community Development Block Grant, however the contractor is local to Fresno.
FISCAL IMPACT
The Fink-White Splash Play Area Project is in Council District 3. The overall cost of the project is $1,578,837 and it is funded with federal CDBG and Measure P funds from category one, “Improving and Maintaining Safe, Clean Neighborhood Parks and Playgrounds.” $1,271,280 of the project budget will be used for the construction contract award, of which $429,300 is CDBG funds, and $842,000 is Measure P. The project will have no impact to the General Fund. All funds necessary to cover the costs for this contract award are included in the adopted FY2023 budget.
