RECOMMENDATIONS

 

Staff recommends that City Council approve an ordinance amending Section 6-223 of the Fresno Municipal Code, relating to special requirements for Commercial Edible Food Generators. 

 

EXECUTIVE SUMMARY

 

On March 10, 2022, the Fresno City Council approved an ordinance amending Article 2, Chapter 6 of the Fresno Municipal Code, relating to waste collection and disposal, to incorporate all of the requirements imposed by SB 1383.  In the preparation of the associated documents, a portion of Section 6-223 was inadvertently omitted from the text of Bill No. B-3, Ordinance No. 2022-003.  The omitted language is now being presented for approval and inclusion in the Fresno Municipal Code to bring the City into full compliance with Senate Bill (SB) 1383 regulations. 

 

BACKGROUND

 

On March 10, 2022, the Fresno City Council approved an ordinance amending Article 2, Chapter 6 of the Fresno Municipal Code (FMC), relating to waste collection and disposal, to incorporate all of the requirements imposed by SB 1383. 

 

When preparing the ordinance for City Council consideration, subsections (a) through (c) from the text of Section 6-223, related to special requirements for commercial edible food generators, specifically regarding edible food recovery requirements, services, and programs, were inadvertently omitted.  Since these requirements are missing from the FMC, the ordinance is not in compliance with the regulations of SB 1383. 

 

DPU is requesting City Council approval of subsections (a) through (c) of FMC Section 6-22 to bring the ordinance into full compliance with SB 1383 regulations for commercial edible food generators. 

 

The ordinance has been approved as to form by the City Attorney’s Office.

 

ENVIRONMENTAL FINDINGS

 

This item is not a “project” for the purposes of the California Environmental Quality Act.

 

LOCAL PREFERENCE

 

Local preference was not implemented, as this item does not involve a bid or award of a construction or services contract.

 

FISCAL IMPACT

 

There is no fiscal impact, as this item is not a project.
