RECOMMENDATIONS

 

Staff recommends the City Council (1) adopt a Mitigated Negative Declaration as prepared for Environmental Assessment No. P24-00678 and P24-00214 (SCH 2024101319) dated October 28, 2024, (2) adopt the 27th Amendment to the Annual Appropriation Resolution (AAR) No. 2024-122 appropriating $502,000.00 for the Senior Activity Center Project (Project), (3) approve Design-Build Contract Amendment No. 1 for Phase Two of a Progressive Design-Build Agreement with Integrated Community Development (ICD) to provide design and construction services related to the Project in an amount not to exceed $30,014,208.00, and authorize the Capital Projects Director or designee to sign a final Contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The Capital Projects Department (CPD) and Parks, After School, Recreation and Community Services Department (PARCS) have initiated and completed Phase One of the Senior Activity Center Project, which included community outreach, schematic design, cost estimation, schedule development, and other preconstruction services. CPD and PARCS now seek to amend the Progressive Design-Build Agreement with ICD to initiate Phase Two Construction Services necessary to finalize design and construct the Project. The Project will construct the Senior Activity Center, located at Blackstone and Holland Avenues, and related on-site improvements such as utilities, parking, landscaping, and recreational amenities. Offsite improvement development is in coordination with the Blackstone and Holland Measure C Transit-Oriented Development project. Upon completion, the Senior Activity Center is anticipated to provide programs and services for thousands of seniors a year.

 

The Progressive Design-Build Agreement Contract Amendment is funded through a combination of Fiscal Year (FY) 2025 appropriations from Measure P Expenditure Category 2, Park Impact Fees, HUD Section 108 loan funds, and General Funds. Approval of the 27th Amendment to the AAR will appropriate $502,000.00 from FY2024 Park Impact Fee Fund Balance Carryover to fully fund the construction contract.

 

BACKGROUND

 

In May 2023, Council approved the use of Fresno Municipal Code Section 4-502(d), Design-Build Qualification Method of procurement for the Project. Through a competitive, qualifications-based procurement process, the Department of Public Works (DPW) advertised a Request for Qualifications (RFQ), and ICD was selected as the Design-Builder for the Project. On July 20, 2023, Council awarded the Phase One Preconstruction Services portion of the Progressive Design-Build Agreement to ICD in the amount of $634,117.00. The Phase One Preconstruction Services portion of the Progressive Design-Build Contract was funded through FY2024 appropriations from Measure P Expenditure Category 2, New Neighborhood Parks: Senior and Youth Recreation Facilities. To date, the City has been invoiced for $522,168 for work completed in Phase One Preconstruction Services.

 

Included in Phase One Preconstruction Services were site assessments, master site planning, community engagement, basis-of-design and plan development, and cost assessment. With staff support, ICD conducted a community outreach campaign consisting of a series of six (6) open houses, seven (7) pop-up events, an online survey and project website, and print, digital, radio and social media advertisements. Based on gathered community feedback, schematic drawings and renderings of the Senior Activity Center were developed and presented to constituents.

 

The Project consists of a two-story, approximately 35,000 square foot Senior Activity Center and related on-site improvements including recreational amenities (heated swimming pool, pickleball courts, bocci ball courts, and open greenspace), sight lighting, landscape and garden areas, pedestrian walkways, parking, drive aisles, and driveways. The Senior Activity Center will provide programs and services for senior residents including, but not limited to, meal and nutrition programs, information and assistance, health and fitness programs, wellness programs, recreation activities, and educational and arts programs.

 

The Phase Two Construction Services portion of the Progressive Design-Build Agreement includes the completion of design services for the Project, the procurement of all materials and equipment for the Project, the performance of construction services for the Project, the start-up, testing, and commissioning of the Project, and the provision of warranty services. The Phase Two portion of the contract includes a guaranteed maximum price (GMP) for construction of $30,014,208.00. Council approval of the Phase Two Construction Services portion of the agreement is recommended in order for the construction of the Senior Activity Center Project to commence. The total contract cost, including Phase One and Phase Two of the Progressive Design-Build Agreement is not to exceed $30,536,376.

The contract utilizes a modified Design-Build Institute of America (DBIA) standard Progressive Design-Build Agreement which has been reviewed and approved as to form by the City Attorney’s Office.

 

The Senior Activity Center Project is federally funded with HUD Section 108 loan funds and the City of Fresno is not authorized to utilize the Community Workforce Agreement (PLA) on this Project due to the funding source requirements.

 

ENVIRONMENTAL FINDINGS

 

NEPA

 

Pursuant to the National Environmental Policy Act (NEPA) guidelines, an Environmental Assessment (EA) was prepared in April 2022, which resulted in a determination of a Finding of No Significant Impact (FONSI).

 

Utilizing the prepared EA, the Housing and Community Development Division received authorization to use grant funds from the U.S. Department of Housing and Urban Development (HUD) on May 27, 2022, for the acquisition of the parcels on which the Senior Activity Center and Affordable Housing Complex will be built.

 

CEQA

 

An environmental assessment Initial Study and Mitigated Negative Declaration (IS/MND) (SCH 2024101319) dated October 28, 2024, was prepared to evaluate the potential environmental impacts associated with the Senior Activity Center Project, including the future affordable housing project, (Development Permits P24-00678 and P24-00214) in compliance with the California Environmental Quality Act (CEQA) Guidelines Section 15070.

 

This process included the posting of a Draft IS/MND for public review and comment for a 20-day period from October 30, 2024, to November 18, 2024, pursuant to the requirements of CEQA Guidelines Section 15105. During the public review period, no public comments were received that would require further environmental analysis, implementation of new or additional mitigation measures, or otherwise cause revisions to or recirculation of the Draft IS/MND.

                     

The IS/MND determined that, with the implementation of mitigation measures developed specifically to reduce project-specific impacts, the project would not result in potentially significant adverse environmental impacts. The IS/MND is a standalone environmental document that addresses project-specific impacts and is included as an attachment to the Council agenda item.

 

LOCAL PREFERENCE

 

Local preference does not apply. The Fresno Municipal Code does not require local preference for design-build and affordable housing projects.

 

FISCAL IMPACT

 

The Senior Activity Center Project is located in Council District 4. The Project is funded through a combination of Measure P Expenditure Category 2, Park Impact Fees, HUD CDBG Section 108 Loan Funds, and General Funds appropriated in the FY25 Budget. Adoption of the attached 27th Amendment to the AAR No. 2024-122 will fully fund Phase Two of the Project.
