RECOMMENDATION

 

It is recommended Council approve the Ninth Amendment to Salary Resolution No. 2016-120 to establish new classification of Transit Scheduler in Exhibit 3, Non-Supervisory White Collar (FCEA); and amend the salary range for Water Conservation Representative, Plans Examiner, and Senior Plans Examiner in Exhibit 3, Non-Supervisory White Collar (FCEA), and Parking Supervisor in Exhibit 13-1, Exempt Supervisory and Professional (CFPEA).

 

EXECUTIVE SUMMARY

 

Following the approval of the Fiscal Year 2017 (FY17) Budget, Personnel Services in collaboration with the Transportation Department, developed a new classification titled Transit Scheduler. The classification is being added to Unit 3, Exhibit 3, Non-Supervisory White Collar (FCEA). 

 

In order to maintain appropriate pay relationships with other classes with similar minimum qualifications and scope of responsibility, the Water Conservation Representative salary range is modified accordingly in Unit 3, Exhibit 3.

 

Effective December 1, 2016, the salary basis test for determining whether or not a classification or position is exempt from overtime provisions of the Fair Labor Standards Act (FLSA) will increase to $3,957 per month. The top step of Parking Supervisor, is below the new floor. This action would change the top step to $3,957, effective December 1, 2016.

 

Additionally, the salary range for Plans Examiner and Senior Plans Examiner is being amended to correct a miscalculation in the Seventh Amendment to the Salary Resolution. The salary range for both classes in Unit 3, Exhibit 3 reflect the correct range for both classes.

 

BACKGROUND

 

The Fiscal Year 2017 Budget reflects a fiscally responsible and sustainable approach to restoring essential City services. In collaboration with respective City Departments, Personnel Services proposes the establishment of new classifications and assigned salary ranges and the amendment of a salary range in order to execute and implement the actions approved in the FY17 budget.

 

The Transit Scheduler classification is being established to provide needed scheduling support for the addition and expansion of transit service. The Transit Scheduler will be responsible for the design, planning, and scheduling of fixed-route bus service, will evaluate the efficiency and effectiveness of service, will recommend modifications to service, driver runs, or assignments to improve service quality, and will develop and analyze service alternatives.

 

Due to the nature and scope of the water conservation program duties, the salary for Water Conservation Representative is being amended to maintain the appropriate pay relationship with other classes with similar minimum qualifications, and nature and scope of responsibility.

 

Effective December 1, 2016, the salary basis test for determining whether or not a classification or position is exempt from overtime provisions of the Fair Labor Standards Act (FLSA) will increase from $455 per week to $913 per week on December 1, 2016. This equates to a change from the current $1,972 per month to a new floor of $3,957 per month.

 

There is one filled classification, Parking Supervisor, whose top step, $3,794, is below the new floor. In order to maintain the FLSA Exempt status of Parking Supervisors, this action would increase the top step of this classification to $3,957, effective December 1, 2016.

 

On September 22, 2016, Council approved the Seventh Amendment to the FY17 Salary Resolution, effective October 3, 2016. Steps B through E of the Plans Examiner and Senior Plans Examiner salary ranges were incorrect due to a clerical miscalculation. The salary ranges for the respective classes are corrected accordingly in Unit 3, Exhibit 3, retroactively effective October 3, 2016. 

 

The City provided notice to all bargaining units regarding the new classifications and their associated salary ranges. The Fresno City Employees Association (FCEA) and the City of Fresno Professional Employees Association (CFPEA) were notified of the City’s intention to modify salary ranges for Water Conservation Representative and Parking Supervisor respectively, and has concluded its meet and confer obligations.

 

The City Attorney’s Office has approved the Ninth Amendment to Salary Resolution No. 2016-120 as to form.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a “project” and is therefore exempt from the California Environmental Quality Act requirements.

 

LOCAL PREFERENCE

 

Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno.

 

FISCAL IMPACT

 

This Salary Resolution Amendment will result in  increased salary and benefit costs in FY 17 of approximately $2,600 for the Parking Supervisor classification and approximately $31,100 for the Water Conservation class which will be absorbed by the respective Departments.  Adoption of the Transit Scheduler classification does not have any fiscal impact.
