Actions pertaining to the North Fulton Parking Structure Project (Council District 3):

2.                     Approve Design-Build Contract Amendment No. 2 for Phase Two of a Progressive Design-Build Agreement with Bomel Construction Company Inc. of Irvine, California, to provide design and construction services related to the North Fulton Parking Structure Project in an amount not to exceed $35,323,776, bringing the total contract amount to $37,278,435.

RECOMMENDATIONS

 

Staff recommends the City Council (1) adopt a Consistency Determination pursuant to California Environmental Quality Act (CEQA) Section 15183, confirming that the North Fulton Parking Structure is consistent with and supported by the Environmental Impact Report prepared for the Downtown Neighborhoods Community Plan, Fulton Corridor Specific Plan, and Downtown Development Code, (2) approve Design-Build Contract Amendment No. 2 for Phase Two of a Progressive Design-Build Agreement with Bomel Construction Company Inc. to provide design and construction services related to the Project for an amount not to exceed $35,323,776, bringing the total contract amount to $37,278,435, and authorize the Capital Projects Director or designee to sign a final Contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The Capital Projects Department (CPD) and Mayor’s Office have initiated and completed Phase One of the North Fulton Parking Structure Project, which included schematic design, cost estimation, schedule development, and other preconstruction services of a 600 or more stall parking structure, located on an existing City-owned and operated surface parking Lot 2, bounded by Tuolumne Street, Broadway Street, Congo Alley, and the approved Merced Street Extension Project.

 

CPD and the Mayor’s Office now seek to amend the Progressive Design-Build Agreement with Bomel Construction Company Inc. to initiate the Phase Two Construction Services necessary to finalize design and construct the Project. Approval of this Amendment will increase the Contract by an amount not to exceed $35,323,776 for a total revised contract value not to exceed $37,278,435. Design-Build Contract Amendment No. 2 for Phase Two of the Progressive Design-Build Agreement is funded by the State of California via the Downtown Fresno Public Infrastructure Improvement Projects Grant and the Infill Infrastructure Grant Catalytic (IIGC) Fiscal Year (FY) 26 appropriations.

 

BACKGROUND

 

In October 2024, Council approved the use of Fresno Municipal Code Section 4-502(d), Design-Build Qualification Method of Procurement for the Project. Through a competitive, qualifications-based procurement process, CPD advertised a Request for Qualifications (RFQ) and Bomel Construction Company Inc. was selected as the Design-Builder for the Project. On June 12, 2025, Council awarded the Phase One Preconstruction Services portion of the Progressive Design-Build Agreement to Bomel Construction Company Inc. in the amount of $1,612,769 and a contingency amount not to exceed $160,000. This approval was for the design of an approximately 234-stall parking structure intended to provide residential parking for future housing developments planned for construction on neighboring parcels.

 

On August 28, 2025, City Council approved Design-Build Contract Amendment No. 1 to the Progressive Design-Build Agreement with Bomel Construction Company Inc., increasing the design fee by $341,890 for a revised total contract value not to exceed $1,954,659. The Amendment also raised the contingency by $35,000, bringing the total contingency to an amount not to exceed $195,000. This design change, enabled by the State of California for the Downtown Fresno Public Infrastructure Improvement Projects Grant, increased the stall count for the North Fulton Parking Structure to 600 or more, expanding its use to include both public and residential parking.

 

Phase One Preconstruction Services included site and area assessments, conceptual and design plan development, and cost assessment of a 600 or more stall parking structure. Phase Two Construction Services of the Progressive Design-Build Agreement includes the completion of design services, procurement of all materials and equipment, performance of construction services, start-up, testing, commissioning, and the provision of warranty services for the Project. The Phase Two portion of the contract includes a guaranteed maximum price (GMP) for construction of $35,323,776. Council approval of the Phase Two Construction Services portion of the Progressive Design-Build Agreement is recommended for the construction of the North Fulton Parking Structure Project to commence. The total contract cost, including Phase One and Phase Two of the Progressive Design-Build Agreement is not to exceed $37,278,435.

 

This contract is covered by the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement To Be Bound.

The North Fulton Parking Structure Project is funded by the State of California via the Downtown Fresno Public Infrastructure Improvement Projects Grant and the IIGC FY26 appropriations.

 

The contract utilizes a modified Design-Build Institute of America (DBIA) standard Progressive Design-Build Agreement which has been reviewed and approved as to form by the City Attorney’s Office.

 

ENVIRONMENTAL FINDINGS

 

The North Fulton Parking Structure is found to have been previously analyzed within the Environmental Impact Report (EIR) published for the Fulton Corridor Specific Plan (FCSP), Downtown Neighborhoods Community Plan (DNCP), and Downtown Development Code (DDC) in July of 2016. After review of the EIR, it was determined that the parking structure does not have any significant environmental impact beyond what was previously analyzed. A Consistency Determination has been drafted to show this project’s consistency with the goals and environmental mitigation measures of the FCSP, DNCP, DDC, and associated EIR in accordance with CEQA Section 15183. It has been included as an attachment to the Council agenda item.

 

LOCAL PREFERENCE

 

Local preference does not apply as this is an amendment to the existing contract.

 

FISCAL IMPACT

 

The North Fulton Parking structure Project is in Council District 3 and will have no impact on the General Fund. The amendment is fully funded by the State of California via the Downtown Fresno Public Infrastructure Improvement Projects Grant and the IIGC FY26 appropriations.
