RECOMMENDATION
It is recommended Council (1) approve the attached successor Memorandum of Understanding (MOU) to implement wages, hours and other terms and conditions of employment for City employees in Unit 11, Fresno Airports Public Safety Officers’ Association, represented by FAPSOA; and (2) adopt the Twelfth Amendment to FY 2026 Salary Resolution No. 2025-177 to amend Exhibit 11.
EXECUTIVE SUMMARY
The City of Fresno and Fresno Airports Public Safety Officers’ Association (FAPSOA - Unit 11) reached a tentative agreement on a successor MOU which will replace the MOU that expired on June 15, 2025. The MOU provides for an agreement from June 16, 2025 through June 14, 2026, increases to wages, and other changes in terms or conditions of employment.
Upon Council approval of the Twelfth Amendment to the FY 2026 Salary Resolution, Exhibit 11 of the FY 2026 Salary Resolution will be updated to reflect the amended Exhibit 11 as approved by Council.
BACKGROUND
The City of Fresno and Fresno Airports Public Safety Officers’ Association (FAPSOA - Unit 11) started meeting in June 2025 to work towards reaching agreement on a successor MOU and the parties reached a tentative agreement on October 22, 2025. Members of the Association ratified on October 22, 2025.
Changes to the MOU are summarized below.
• Term: One-year contract effective June 16, 2025 through June 14, 2026.
• Salaries: FY26: 3% wage increase effective November 17, 2025.
• Uniform Allowance: Adding clarifying language, increasing from $1,200 to $1,300 per year, and changing to be paid bi-annually.
• Overtime and CTO: Adding a new section for overtime and moving over overtime language from the Hours and Work Schedule section, and increasing the maximum CTO accrual from 60 to 80 hours in the CTO section and adding clarifying language.
• Call Back Pay: Adding new premium pay of call back pay with a minimum of three (3) hours.
• Health Reimbursement Arrangement (HRA): Adding that accumulated Supplemental Sick Leave can go towards HRA.
• Hours and Work Schedules: Adding clarifying language on the total work hours in a work period, hourly rate of pay, and total work hours equal to one year of service.
• Permanent Part-Time (PPT) Employees: Adding clarifying language on overtime and the probationary period for PPT employees.
• Sick Leave: Updating the Sick Leave section to be consistent with state law.
• Holiday Leave: Adding clarifying language on the monthly accrual and the period in which cash outs are not allowed.
In addition to the above, there was language clean up throughout the MOU.
The City Attorney’s Office has approved the new MOU and Salary Resolution Amendment as to form.
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a “project” and is therefore exempt from the California Environmental Quality Act requirements.
LOCAL PREFERENCE
Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno.
FISCAL IMPACT
Approval of the MOU and Salary Resolution Amendment will result in estimated additional salary and benefit expenses of $0 to the General Fund and $43,201 to All Funds in FY26 for the term of the MOU, which expires June 14, 2026.
