2.                     Award a construction contract in the amount of $937,573.30 with Power Design Electric, Inc., of Kingsburg, California, as the lowest responsive and responsible bidder for the Koligian Park Soccer and Volleyball Lighting Improvements Project.

RECOMMENDATIONS

 

Staff recommends that Council (1) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301, Class 1 of the California Environmental Quality Act (CEQA) Guidelines, for the Koligian Park Soccer and Volleyball Lighting Improvements Project (2)  award a construction contract in the amount of $937,573.30 to Power Design Electric, Inc. of Kingsburg, California, as the lowest responsive and responsible bidder for the Koligian Park Soccer and Volleyball Lighting Improvements Project (Project), and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno (City).

 

EXECUTIVE SUMMARY

 

The Capital Projects Department seeks to award a construction contract to Power Design Electric, Inc. following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $937,573.30. The project will enhance the playing fields within Koligian Park located at 5165 West Alluvial Avenue. The scope of work includes installing lighting to the soccer fields and volleyball court. The Project will be funded with American Rescue Plan Act (ARPA) and Measure P, Expenditure Category 1 allocations adopted in the Fiscal Year 2025 (FY25) Budget.

 

BACKGROUND

 

The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) proposes to improve safety and visibility at Koligian Park by installing sports lighting at the soccer fields and volleyball court. Koligian Park is a 7-acre park located on the southwest corner of West Alluvial Avenue and North Dante Avenue.  The park contains a tot lot area, picnic shelter, restroom building, basketball court, dog park, volleyball court, and two soccer fields.  The site currently has walkway lighting only. The scope of work for the project includes installation of six (6) field light poles with eight (8) LED light fixtures at the soccer field. Additionally, two (2) court light poles with two (2) LED light fixtures will be installed at the volleyball court. Pursuant to these goals, the City entered into an agreement with O’Dell Engineering dated February 15, 2024, for design and preparation of construction documents for the project.

 

A Notice Inviting Bids was advertised and published in the Business Journal, Planet Bids, and posted on the City’s website on September 25, 2024. The Project plans and specifications were distributed to Thirty (30) prospective bidders and posted at Twelve (12) building exchanges. Five (5) sealed bid proposals were received and opened in a public bid opening on October 25, 2024, with bid amounts ranging from $937,573.30 to $1,476,532.00. Power Design Electric, Inc. was determined to be the lowest responsive and responsible bidder in the amount of $937,573.30.  The bids will expire on December 28, 2024. If the bids are rejected or expire, the Project must be rebid which will result in a delay to the Project and a loss of ARPA funding.

 

The Community Workforce Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this project was less than $1 million, pursuant to the terms of the PLA.

 

Staff recommends Council adopt a finding of a Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 of the CEQA Guidelines, for the Koligian Park Soccer and Volleyball Lighting Improvements Project, and award a construction contract to Power Design Electric, Inc. of Kingsburg, California, in the amount of $937,573.30, as the lowest responsive and responsible bidder for the Koligian Park Soccer and Volleyball Lighting Improvements Project, and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno.

 

The City Attorney’s Office has reviewed and approved all documents as to form.

 

ENVIRONMENTAL FINDINGS

 

Staff has determined that a Categorical Exemption is appropriate based on Section 15301/Class 1 (Existing Facilities), which consists of the repair, maintenance, and/or minor alteration of existing public or private structures or facilities, involving negligible or no expansion of the use beyond that existing at the time of this determination.  The project will implement site lighting improvements at the existing Koligian Park to address community recreation needs and safety and enable the full range of recreation uses consistent with the existing park site and uses.  The proposed lighting improvements will not expand or include incompatible uses or changes to the existing purpose of the community park site.  Therefore, the proposed project would focus on minor site alterations and repairs to the existing site facilities that would not involve the expansion of an existing use or include incompatible uses or changes to the existing purpose of the park facility. 

 

Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this Project.  Staff recommends that Council, based upon its own independent judgment, adopt a finding of a Categorical Exemption per Staff determination, pursuant to Section 15301, Class 1 of the CEQA Guidelines for the Koligian Park Soccer and Volleyball Lighting Improvements Project.

 

LOCAL PREFERENCE

 

Local Preference was not implemented because of federal ARPA funding.

 

FISCAL IMPACT

 

The Koligian Park Soccer and Volleyball Lighting Improvements Project is located in Council District 2 and will have no impact to the General Fund.  The Project is funded utilizing ARPA and Measure P, Expenditure Category 1 funds.
