RECOMMENDATION
 
Staff recommends that the City Council authorize the modification of Resolution 2015-57 to include specific language regarding Assembly Bill  (AB) 1012 to Fresno Council of Governments (Fresno COG) for the 2013 Lifeline Congestion Mitigation and Air Quality Improvement Program and authorize the execution of all related documents by the Public Works Director or his designee.
 
EXECUTIVE SUMMARY
 
Staff is requesting the modification of Resolution 2015-57 to include specific language regarding AB1012 and the "timely use" of State and Federal funding for the grant applications submitted to Fresno COG for the 2013 Lifeline Congestion Mitigation and Air Quality Improvement Program (CMAQ).  These projects are the purchase of an additional Compressed Natural Gas (CNG) sweeper for $409,000; the construction of the bankside trail on the south side of Shields Avenue from First to Fresno Street for $705,000; and identification of the limits of the Barstow Avenue bike lane and sidewalk from Maroa to Del Mar for $387,400.
 
BACKGROUND
 
On April 9, 2015, Council approved Resolution 2015-57 submitting two new applications to Fresno Council of Governments 2013/14 Congestion Mitigation and Air Quality Improvement Program and the Regional Surface Transportation Program, and authorized the execution of all related documents by the Public Works Director or his designee.
 
The applications and resolutions were submitted, but Fresno COG is requesting that the City include specific language that the City will abide by AB 1012.  This State Law provides for the "timely use" of State and Federal funding.  These projects are the purchase of an additional CNG sweeper for $409,000 and the construction of the bankside trail on the south side of Shields Avenue from First to Fresno Street for $705,000.  It will also identify the limits of the Barstow Avenue bike lane and sidewalk which has already been submitted to COG for $387,400, to read from "Maroa to Del Mar" instead of from "Maroa to Blackstone."     
 
The funding is already programmed for the City and we just need to submit a modified Resolution 2015-57 to Fresno COG updating these two new projects in order to proceed with finalizing the funding requests.
 
ENVIRONMENTAL FINDINGS
 
By the definition in the California Environmental Quality Act (CEQA) Guidelines Section 15378, the applying for grant funds does not qualify as a "project" as defined CEQA.
 
LOCAL PREFERENCE
 
Local preference was not considered because this Resolution does not include a bid or award of a construction or services contract.
 
FISCAL IMPACT
 
Local match funds will be identified through future fiscal year capital budgets.  Pedestrian and bicycle projects typically match funding through gas tax, Measure "C" Bike Lane and Trail funds as appropriate for the particular project.
