RECOMMENDATION

 

Staff recommends City Council approve Phase One of a Progressive Design-Build Contract (Contract) with Bomel Construction Company Inc., of Irvine, California, to provide design support services related to the North Fulton Parking Structure Project (Project) in an amount not to exceed $1,612,769.00 with a contingency of $160,000.00, and authorize the Capital Projects Interim Director or designee to execute a final Contract on behalf of the City of Fresno (City).

 

EXECUTIVE SUMMARY

 

In October 2024, Council approved the use of a Design-Build project delivery method for the North Fulton Parking Structure Project. Staff issued a Request for Qualifications (RFQ) to develop the Project and received five responsible and responsive Statements of Qualifications (SOQ). Based on the evaluation completed by a selections panel, staff recommends approving a Progressive Design-Build agreement with Bomel Construction Company, Inc. (Consultant), for the design of the approximate 234 stall parking structure located at APN 466-206-50T and 466-206-51T within Downtown Fresno.

 

The Capital Projects Department (CPD) and Consultant shall work collaboratively along with all stakeholders, to design the North Fulton Parking Structure in accordance with the Project’s scope and budget. The Project’s delivery method takes advantage of the Design-Builder’s expertise during all stages of design, funding, and construction, and provides a high degree of cost and schedule certainty. Council approval of Phase One of a Progressive Design-Build Contract is required in order for the design of the North Fulton Parking Structure Project to commence. The Progressive Design-Build Contract is funded through fiscal year (FY) 2025 appropriations from the Infill Infrastructure Grant - Catalytic (IIGC) from the state of California.

 

BACKGROUND

 

The North Fulton Parking Structure Project includes the design and construction of an approximate 234-stall parking structure located at APN 466-206-50T and 466-206-51T within the City of Fresno’s downtown area. The Project will be a multi-level facility located on the southern half of the property (along Merced Street) providing residential parking for future housing development. Since the parking structure will be completed well ahead of any housing development, it will supply interim permit parking for the neighboring businesses contracted with the City, as the surface parking Lot 2 does currently. This arrangement will be in place until construction for future housing development concludes. The completed structure will provide tenants of the future housing development with safe and secure parking complete with EV charging stations and designated bicycle and motorcycle parking to facilitate easy access to Fresno’s many attractions.

 

On October 31, 2024, Council approved the use of Fresno Municipal Code Section 4-502(d), Design- Build Qualification Method of procurement for the project. Through a competitive Progressive Design Build procurement process, CPD advertised a Request for Qualifications (RFQ) on March 18, 2025, via Planet Bids and direct email to prospective design-build teams with the capability and experience necessary to execute the North Fulton Parking Structure Project. Five design-build teams responded to the RFQ. Their qualifications were evaluated and rated by a committee of five in accordance with the provisions of the RFQ, and an interview was conducted with all five of the design-build teams. The evaluation committee consisted of staff representing different City departments, including Capital Projects, Planning and Development, and the Mayor’s Office. Bomel Construction, based in Irvine, California, and their team, including Choate Parking Consultants (CPC), Culp & Tanner, Inc., Salas O’Brien, and Provost & Pritchard, was determined to be the most qualified team to collaboratively work with the City and provide the best opportunity to meet the Project goals and required outcome.

 

Staff recommends City Council approve the proposed Progressive Design-Build contract with Bomel Construction Company Inc., in an amount not to exceed $1,612,769.00 with a contingency amount of $160,000.00, for design support services and the preparation of construction documents for the North Fulton Parking Structure Project and authorize the Capital Projects Interim Director or designee to execute the final Contract on behalf of the City.

 

The Progressive Design Build Contract utilizes a modified Design-Build Institute of American (DBIA) standard Progressive Design-Build Agreement which has been reviewed and approved by the City Attorney’s Office as to form.

 

Planned future actions associated with the North Fulton Parking Structure Project include executing Phase Two (construction) of the Progressive Design-Build contract.

 

ENVIRONMENTAL FINDINGS

 

Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, this is not a “project’ as defined by CEQA.

 

LOCAL PREFERENCE

 

Bomel Construction Company, Inc. is not considered a local business as defined by the Fresno Municipal Code, however one of their design subconsultants would be considered a local business.

 

FISCAL IMPACT

 

The proposed project is in Council District 3. The Progressive Design-Build Contract is funded through FY 2025 appropriations by the Infill Infrastructure Grant - Catalytic through the State of California and will have no impact to the General Fund.
