RECOMMENDATION
Staff recommends that the City Council award a construction contract in the amount of $570,840 to Avison Construction Company of Madera, California, as the lowest responsive and responsible bidder for the Nees Avenue Westbound Widening from Maple Avenue to Hayston Avenue and authorize the Public Works Director or designee to sign the contract on the City’s behalf.
EXECUTIVE SUMMARY
The proposed westbound widening of Nees Avenue between Maple Avenue and Hayston Avenue will provide for more efficient vehicle movement on Nees Avenue by eliminating traffic congestion particularly at peak travel times. The installation of sidewalk on the north side of Nees Avenue will also provide for easier pedestrian travel on this section of Nees Avenue.
BACKGROUND
The project will help alleviate traffic congestion on Nees Avenue by widening the street for westbound traffic from one lane to two lanes between Maple Avenue and Hayston Avenue. Work includes clearing and grubbing, asphalt saw cutting, roadway excavation and grading, aggregate base and asphalt paving, sidewalk and ADA compliant curb ramp and return, curb and gutter, pavement markers, striping and road signage, traffic signal modifications and streetlights.
The project also includes installing master planned storm drain improvements in Nees Avenue. The cost for these improvements is $73,793, and will be reimbursed by the Fresno Metropolitan Flood Control District (FMFCD) through a cooperative agreement with the City.
Staff prepared project plans and specifications and a Notice Inviting Bids was published in the Business Journal on August 5, 2016, posted on the City’s website and faxed to eleven building exchanges. The specifications were distributed to thirteen prospective bidders. Six sealed bid proposals were received and opened in a public bid opening on September 13, 2016, with bids ranging from $570,840 to $706,376. Avison Construction Company of Madera was deemed the lowest responsive and responsible bidder. Bids will expire within sixty-four days as of the bid opening date, i.e., as of November 16, 2016.

ENVIRONMENTAL FINDINGS
An initial study was prepared for the East Nees Avenue Widening Project which resulted in the preparation of a Finding of Conformity pursuant to CEQA Guidelines §15177. The Finding of Conformity EA-12-018 was adopted by the Council on October 31, 2013 for the East Nees Avenue Widening Project. The City proposes to construct an additional westbound travel lane and bike lane along East Nees Avenue between North Maple Avenue and North Hayston Avenue. The project will also include constructing curb, gutter, sidewalk, drive approaches, an ADA curb ramp installation of street lights along the north side of East Nees Avenue within the project area defined above, and modifications of the existing traffic signal located at the northwest corner of East Nees Avenues and North Maple Avenue. The project also includes the removal of existing trees, relocation of storm drain facilities, relocation of CATV and AT&T facilities, undergrounding of PG&E electrical facilities, and land acquisition by the City of Fresno. This approval is to implement a portion of that project.
An analysis has been performed pursuant CEQA Guidelines § 15162 to determine whether subsequent environmental review is required for this approval. Based upon this analysis the following findings are made to support the determination that no subsequent environmental review is required:
1. No substantial changes are proposed in the project which will require major revisions of the previous Finding of Conformity due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. In this case, there are no changes to the project.
2. No substantial changes occur with respect to the circumstances under which the project is undertaken which will require major revisions of the previous Finding of Conformity due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. In this case, there are no changes to the project.
3. There is no new information, which was not known and could not have been known at the time of the previous Finding of Conformity that the project will have significant effect not discussed in the Finding of Conformity.
Furthermore, it has been determined that none of the mitigation measures and alternatives previously determined to be infeasible are now feasible. In addition, no new mitigation measures or alternatives that would substantially reduce one or more significant effect on the environment have been identified.
Based upon these findings, it has been determined that no further environmental documentation is required for this project.
LOCAL PREFERENCE
Local preference was not implemented because the lowest responsive and responsible bidder is a local business.
FISCAL IMPACT
The westbound widening project on Nees Avenue between Maple Avenue and Hayston Avenue is located in District 6. The overall cost of the project is $1,045,924 and is funded by $794,323 in New Growth Area Street Impact Fees; $104,593 by Proposition 111 Gas Tax Revenue; $73,215 by Traffic signal Mitigation Impact Fees; and $73,793 by a cooperative agreement with the FMFCD. The project will not have any impact to the General Fund. Of the overall cost of the project, $570,840 will be used for the construction contract award.
