Actions pertaining to the Parking Automation and Video Surveillance Project (Council District 3):
1. Adopt a finding of Categorical Exemption per staff’s determinations, pursuant to Section 15301/Class 1 of the California Environmental Quality Act Guidelines, Environmental Assessment No. PS00012, for the Convention Center Garage project location;
2. Adopt a finding of Categorical Exemption per staff’s determinations, pursuant to Section 15301/Class 1 of the California Environmental Quality Act Guidelines, Environmental Assessment No. PS00012, for the Underground Garage project location;
3. Adopt a finding of Categorical Exemption per staff’s determinations, pursuant to Section 15301/Class 1 of the California Environmental Quality Act Guidelines, Environmental Assessment No. PS00012, for the Spiral Garage project location;
4. ***RESOLUTION - Adopt the 12th Amendment to the Annual Appropriation Resolution No. 2025-179 appropriating $1,980,000.00 for the Parking Automation and Video Surveillance Project (Requires 5 Affirmative Votes) (Subject to Mayor’s Veto);

RECOMMENDATIONS
Staff recommends the City Council (1) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 of the CEQA Guidelines, Environmental Assessment No. PS00012, for the Convention Center Garage project location, (2) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 of the CEQA Guidelines, Environmental Assessment No. PS00012, for the Underground Garage project location, (3) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. PS00012, for the Spiral Garage project location, (4) adopt the 12th Amendment to the Annual Appropriation Resolution (AAR) No. 2025-179 appropriating $1,980,000 for the Parking Automation and Video Surveillance Project (Project), (5) approve Design-Build Contract Amendment No.1 for Phase Two of a Progressive Design-Build Agreement with Swinerton Builders to provide design and construction services related to the Project in an amount not to exceed $2,287,859, bringing the total contract amount to $2,889,380, and authorize the Capital Projects Director or designee to sign all documents on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The Capital Projects Department (CPD) and Planning and Development Department (P&D) have initiated and completed Phase One of the Parking Automaton and Video Surveillance Project, which included, schematic design, cost estimation, schedule development, and other preconstruction services. CPD and P&D now seek to amend the Progressive Design-Build Agreement with Swinerton Builders to initiate Phase Two Construction Services necessary to finalize design and construct the proposed improvements. The Project involves removal of the existing Parking Access and Revenue Control Systems (PARCS), including the decommissioning and disposal of all associated equipment such as barrier gates. The existing gated system will be replaced with a modern, gateless PARCS solution designed to streamline parking operations and enhance user’s experience.
Design-Build Contract Amendment No.1 is funded through a combination of Fiscal Year (FY) 2025 appropriations from the General Fund and American Rescue Plan Act (ARPA).
BACKGROUND
In May 2023, Council approved the use of Fresno Municipal Code Section 4-502(d), Design-Build Qualification Method of procurement for the Project. Through a competitive, qualifications-based procurement process, CPD advertised a Request for Qualifications (RFQ), and Swinerton Builders was selected as the Design-Builder for the Project. On June 13, 2024, Council awarded the Phase One Preconstruction Services portion of the Progressive Design-Build Agreement to Swinerton Builders in the amount of $601,521. The Phase One Preconstruction Services portion of the Progressive Design-Build Contract was funded through FY2024 appropriations from the General Fund.
Phase One Preconstruction Services included the development of basis-of-design documents, preliminary plan development, and a comprehensive cost assessment. The Project consists of the removal of the existing gated infrastructure and the installation of a new gateless PARCS solution, the installation of all necessary electrical and utility infrastructure to support the new system, as well as the integration of security surveillance cameras to enhance facility safety and monitoring capabilities at the following parking facilities: The Convention Center Garage, Underground Garage, and Spiral Garage all located within downtown Fresno.
The Phase Two Construction Services portion of the Progressive Design-Build Agreement includes the completion of design services for the Project, the procurement of all materials and equipment for the Project, the performance of construction services for the Project, the start-up, testing, and commissioning of the Project, and the provision of warranty services. Actual construction will begin once the project design is complete from the current 80% design level to the 100% design level. The Phase Two portion of the contract includes a Guaranteed Maximum Price (GMP) for construction of $2,287,859. Council approval of the Phase Two Construction Services portion of the Agreement will allow construction of the Parking Automation and Video Surveillance Project to commence. Staff now recommends City Council adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 of the CEQA Guidelines, Environmental Assessment No. PS00012, for the Convention Center Garage, Underground Garage, and Spiral Garage Project locations, adopt the 12th Amendment to the AAR No. 2025-179 appropriating $1,980,000 for the Parking Automation and Video Surveillance Project, and approve Design-Build Contract Amendment No.1 for Phase Two of a Progressive Design-Build Agreement with Swinerton Builders to provide design and construction services related to the Project in an amount not to exceed $2,287,859, and authorize the Capital Projects Director or designee to sign all documents on behalf of the City of Fresno. The Project is funded through a combination of FY2026 appropriations from the General Fund and ARPA.
This contract is covered by the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement To Be Bound.
The contract utilizes a modified Design-Build Institute of America (DBIA) standard Progressive Design-Build Agreement which has been reviewed and approved as to form by the City Attorney’s Office.
ENVIRONMENTAL FINDINGS
Staff performed an environmental assessment of this Project and determined that if falls within the Categorical Exemption set forth in CEQA Guidelines, Section 15301/Class 1 for Existing Facilities because the Project includes minor alterations to existing facilities involving negligible expansion of the existing use. Please see the attached Environmental Assessments for more information.
None of the exceptions to Categorical Exemptions set forth in the CEQA guidelines Section 1300.2 apply to this project. Therefore, a categorical exemption from CEQA, as noted, above, has been prepared for this project.
LOCAL PREFERENCE
Local preference does not apply as this is an amendment to the existing contract.
FISCAL IMPACT
The Parking Automation and Video Surveillance Project is located in Council District 3. The Project is funded through a combination of General Fund and ARPA Funds appropriated in the FY 2026 Budget. Adoption of the attached 12th Amendment to the AAR No. 2025-179 will fully fund Phase Two of the Project.
