***RESOLUTION - Adopt the 6th Amendment to FY 2023 Salary Resolution No. 2022-152, amending Exhibit 8, Unit 8, Non-Represented to increase the salary range for the Lifeguard, Services Aide and Intern classifications from $15.00 - $19.00 per hour to $15.50 - $19.50 per hour; increase the Police Cadet I classification salary range from $15.00 - $20.00 to $15.50 to $20.50 per hour; increase the Senior Lifeguard classification salary range from $15.50 - $20.00 to $16.00 - $20.50 per hour; increase the minimum salary range of Sports Official classification from $15.00 to $15.50 per game; and amend the Cashier Clerk classification salary range from Flat Rate to Hourly with a salary range of $15.50 - $19.50 per hour, effective January 1, 2023 (Subject to Mayor’s Veto)

RECOMMENDATION
It is recommended that Council adopt the Sixth Amendment to the FY 2023 Salary Resolution No. 2022-152, amending Exhibit 8, Unit 8, Non-Represented effective January 1, 2023 to:
• amend the Cashier Clerk classification salary range from Flat Rate to Hourly with a salary range of $15.50 - $19.50 per hour;
• increase the Police Cadet I classification salary range from $15.00 - $20.00 to $15.50 - $20.50 per hour;
• increase the Senior Lifeguard classification salary range from $15.50 - $20.00 to $16.00 - $20.50 per hour;
• increase the minimum salary range of the Sports Official classification from $15.00 per game to $15.50 per game; and
• increase the salary range from $15.00 - $19.00 to $15.50 - $19.50 per hour for the Lifeguard, Services Aide and Intern classifications.
EXECUTIVE SUMMARY
Effective January 1, 2023, the minimum wage in California will increase to $15.50 per hour. To maintain compliance with the California State law, it is required to increase the minimum starting salary by .50 cents for all affected classifications in Exhibit 8, Unit 8, Non-Represented. It is recommended to increase the minimum and maximum salary range from $15.00 - $19.00 to $15.50 - $19.50 per hour for the classifications of Lifeguard, Services Aide and Intern in Exhibit 8, Unit 8, Non-Represented, effective January 1, 2023.
It is recommended to increase the salary range for the Police Cadet I classification from $15.00 - $20.00 to $15.50 - $20.50 per hour; increase the salary range for the Senior Lifeguard classification from $15.50 - $20.00 to $16.00 - $20.50 per hour to maintain consistency with the Lifeguard salary increase; increase the minimum salary range for the Sports Official classification from $15.00 to $15.50 per game; and modify the Cashier Clerk classification salary range from Flat Rate to Hourly with a salary range of $15.50 - $19.50 per hour consistent with other comparable Hourly classifications in Exhibit 8, Unit 8, Non-Represented.
At this time, the classifications that will receive a salary range increase are as follows: Cashier Clerk, Lifeguard, Police Cadet I, Senior Lifeguard, Services Aide, Sports Official, and Intern. It is anticipated that all affected Departments have sufficient appropriations to address the costs associated with this adjustment; however, should a Department require additional appropriations, it will revisit associated costs during the mid-year budget review.
To implement these actions, it is necessary to adopt the Sixth Amendment to FY 2023 Salary Resolution No. 2022-152.
BACKGROUND
Effective January 1, 2023, the minimum wage in California will increase to $15.50 per hour for all employers regardless of the number of staff employed. The City of Fresno is required to increase the minimum starting salary for all affected classifications in Exhibit 8, Unit 8, Non-Represented from $15.00 to $15.50.
It is recommended that the minimum salary range for the classifications of Lifeguard, Police Cadet I, Services Aide and Intern classifications in Exhibit 8, Unit 8, Non-Represented, be increased by .50 cents, effective January 1, 2023, to be in compliance with the California state law. To be consistent with the minimum salary range increase, it is also recommended to increase the maximum salary range by .50 cents for the Lifeguard, Services Aide and Intern classifications from $19.00 to $19.50; and increase the maximum salary range of the Police Cadet I classification from $20.00 to $20.50 per hour.
Additionally, it is also recommended to increase the minimum salary range for the Sports Official classification from $15.00 to $15.50 per game. It is recommended that the salary range of the Cashier Clerk classification be modified from Flat Rate to Hourly with a salary range of $15.50 - $19.50 per hour; and increase the salary range of the Senior Lifeguard classification from $15.50 - $20.00 to $16.00 - $20.50 per hour to maintain parity with the Lifeguard classification salary increase; and to be consistent overall with other comparable Hourly salary range classifications in Exhibit 8, Unit 8, Non-Represented.
It is anticipated that all affected Departments have sufficient appropriations to address the costs associated with this adjustment; however, should a Department require additional appropriations, it will revisit associated costs during the mid-year budget review.
The City Attorney’s Office has approved the Sixth Amendment to Salary Resolution No. 2022-152 as to form.
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a “project” and is therefore exempt from the California Environmental Quality Act requirements.
LOCAL PREFERENCE
Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno.
FISCAL IMPACT
It is anticipated that all affected Departments have sufficient appropriations to address the costs associated with this adjustment; however, should a Department require additional appropriations, it will revisit associated costs during the mid-year budget review.
