RECOMMENDATION

 

Staff recommends City Council approve the First Amendment to the Consultant Services Agreement with MLA Green Inc., DBA Studio MLA, in the amount of $44,000, increasing the contract amount to $825,195, with a remaining contingency of $34,500, for the No.13 Park at MLK Magnet Core Project and authorize the Public Works Director or designee to execute the First Amendment on behalf of the City of Fresno.     

 

EXECUTIVE SUMMARY

 

The City and Consultant have been progressing with the design for the No.13 Park at MLK Magnet Core Project.  City staff have identified the need to include additional park amenities in the form of a tot lot feature within the park project.  Therefore, the City desires to amend the scope of the consultant agreement to include the design of a tot lot as part of the project.  This addition to the park project will be funded by Park Impact Fees. 

 

BACKGROUND

 

The proposed park-site is located on the southwest corner of South Martin Luther King Boulevard and East Church Avenue.  The City of Fresno has partnered with Strategic Growth Council (SGC) to construct a park facility under the Transformative Climate Communities (TCC) Program.  The tot lot amenity will be in addition to the scope of the TCC funded park project.

 

City staff identified the additional scope and pursued a proposal from MLA Green Inc. to add design and construction documents for a tot lot to the park project agreement.  The tot lot will add an additional play opportunity not currently funded by the TCC grant.       

 

In March 2020, staff published a Request for Qualifications inviting qualified architectural consultants in accordance with Administrative Order (A.O.) 6-19 to submit Statements of Qualifications to plan and design a new park facility for the City of Fresno.  Six firms were interviewed in June 2020.  Once the interview scoring sheets were tabulated, it was determined that MLA Green Inc., DBA Studio MLA was deemed the most qualified firm for the project. The original agreement dated October 7th, 2021, with MLA Green Inc. totaled $781,195, with a contingency of $34,500. The proposed First Amendment will increase the contract amount by $44,000 bringing the contract amount to $825,195, with a remaining contingency of $34,500.

 

The City Attorney’s Office has reviewed and approved as to form.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378 the contract amendment approval does not qualify as a project as defined by CEQA.

 

LOCAL PREFERENCE

 

Local preference was not implemented; this is an amendment to an existing agreement.    

 

FISCAL IMPACT

 

The project, located in Council District 3, will not have any impact on the General Fund.  The amendment amount of $44,000 will be funded by Park Impact Fees.  All funds necessary for the contract amendment are included in the current fiscal year budget.
