Title
Actions pertaining to the Holmes Park Restroom Replacement Project (Bid File 12501359) (Council District 3):
1. Adopt a finding of a Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 and Section 15302/Class 2 of the California Environmental Quality Act (CEQA) Guidelines;
2. Award a construction contract in the amount of $543,693.78 with Puma Construction Co., Inc., of Fresno, California, as the lowest responsive and responsible bidder for the Holmes Park Restroom Replacement Project; and authorize the Capital Projects Director or designee to sign the agreement on behalf of the City.

RECOMMENDATIONS
Staff recommends the City Council (1) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301, Class 1 and Section 15302/Class 2 of the California Environmental Quality Act (CEQA) Guidelines, (2) award a construction contract in the amount of $543,693.78 to Puma Construction Co. Inc., of Fresno, California, as the lowest responsive and responsible bidder for the Holmes Park Restroom Replacement Project (Project), and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
The Capital Projects Department (CPD) seeks to award a construction contract to Puma Construction Co. Inc., following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $543,693.78. The Project will enhance the park experience for all guests by providing a new restroom building that fully complies with Americans with Disabilities Act (ADA) standards. The facility will include four individual stalls, two of which will be ADA accessible. The construction contract will be funded utilizing Measure P, Expenditure Category 1 Funds.
BACKGROUND
Holmes Park is a 9.28-acre park located on the northwest corner of South First Street and East Huntington Boulevard. The park contains a multi-purpose field used for baseball and soccer, basketball courts, tennis courts, a tot lot, picnic area, amphitheater, lawn bowling fields and two restroom buildings, one of which is no longer in use. The Parks, After School, Recreation and Community Services (PARCS) Department wishes to better serve guests of Holmes Park by demolishing the existing restroom at the north end of the park and replacing it with a new prefabricated restroom while also updating the existing sewage, water and electrical services. The existing path of travel walkways from the accessible parking spaces will be improved as well to meet all current code requirements. The new prefabricated restroom building will include four separate stalls, two of which will meet all accessibility requirements, two exterior drinking fountains and two exterior sinks.
This project will also demolish the existing restroom at the southwest corner of the park that has been out of use for many years. The electrical cabinets that are currently attached to the exterior of the south restroom will be relocated within a new electrical cabinet to be installed adjacent to the existing cabinet at that location. All water and sewer connections will be removed and capped.
On July 20, 2023, City Council approved an On-Call Consultant Services Agreement with GHD, Inc. for architectural and engineering design services on Fresno parks capital improvement projects (Citywide). On February 12, 2024, the Capital Projects Department approved a Task Order with GHD, Inc. for the design and preparation of construction documents for the Project.
A Notice Inviting Bids was published on Planet Bids and posted on the City’s website on March 25, 2025. The Project plans and specifications were distributed to thirty-two (32) prospective bidders and posted at nine (9) building exchanges. Six (6) sealed bid proposals were received and opened in a public bid opening on April 22, 2025, with bid amounts ranging from $543,693.78 to $892,460.00. Puma Construction Co. Inc., was determined to be the lowest responsive and responsible bidder in the amount of $543,693.78. The bids will expire on June 25, 2025. If the bids are rejected or expire, the Project must be rebid which will result in a delay to the Project.
The Community Workforce Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this Project was less than $1 million, pursuant to the terms of the PLA.
Staff recommends Council adopt a finding of a Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 and Section 15302/Class 2 of the CEQA Guidelines and award a construction contract to Puma Construction Co. Inc., of Fresno, California, in the amount of $543,693.78, as the lowest responsive and responsible bidder for the Holmes Park Restroom Replacement Project, and authorize the Capital Projects Interim Director or designee to sign the standardized construction contract on behalf of the City of Fresno. The construction contract will be funded utilizing Measure P, Expenditure Category 1 Funds.
The City Attorney’s Office has reviewed and approved the standard contract as to form.
ENVIRONMENTAL FINDINGS
Staff has determined that a Categorical Exemption is appropriate based on Section 15301/Class 1 (Existing Facilities), which consists of the repair, maintenance, and/or minor alteration of existing public or private structures or facilities, involving negligible or no expansion of the use beyond that existing of the time of this determination; and Section 15302/Class 2 (Replacement or Reconstruction), which consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The Project involves the replacement of existing restroom facilities within Holmes Park in the same location as the existing facilities and will have the same purpose and general capacity as the structure it is replacing.
Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this Project. Staff recommends that Council, based upon its own independent judgment, adopt the finding of a Categorical Exemption per Staff determination, pursuant to Section 15301, Class 1 and 15302, Class 2 of the CEQA Guidelines for the Holmes Park Restroom Replacement Project.
LOCAL PREFERENCE
Puma Construction Co., Inc. is a local business, as defined by the Fresno Municipal Code.
FISCAL IMPACT
The Holmes Park Restroom Replacement Project is located in District 3 and will have no impact to the General Fund. The Project will be funded utilizing Measure P, Expenditure Category 1 Funds.
