RECOMMENDATION

 

Staff recommends the City Council approve a Fourth Amendment to the Consultant Services Agreement, dated January 3, 2019, with Blair, Church, and Flynn Consulting Engineers, Inc., in the amount of $55,400, increasing the total contract amount to $268,179.72, for the Fresno Midtown Trail Project on the north bank of the Mill Ditch along McKinley Avenue from Millbrook Avenue to Clovis Avenue, and authorize the Public Works Director or designee to sign and execute the Fourth Amendment to the Agreement on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The City is proposing to construct a pedestrian and cycle multipurpose trail on the north bank of the Mill Ditch along McKinley Avenue from Millbrook Avenue to Clovis Avenue, which is referred to as Segment 4 of the Midtown Trail Program. The City entered into the Consultant Services Agreement with Blair, Church, and Flynn Consulting Engineers, Inc., for Segment 4 and Segment 5, on January 3, 2019. This Fourth Amendment to the Agreement includes additional design services in order to finalize the construction documents and third party coordination for Segment 4 in preparation for bidding the project. The cost of the Fourth Amendment is $55,400, increasing the total contract amount to $268,179.72 for Segment 4, and will be funded with local Measure C Trails funding.

 

BACKGROUND

 

This project is part of the Midtown Trail Program, a planned pedestrian and cycle multipurpose trail along the banks of the FID’s Herndon Canal and Mill Ditch, which will ultimately provide continuous trail facilities from the intersection of Blackstone Avenue and Shields Avenue to a connection with the Clovis Old Town Trail on Clovis Avenue. In addition to the pedestrian and cycle multipurpose trail improvements, this project proposes concrete curb and gutter, trail lighting and landscaping and irrigation along the trail-side bank of Mill Ditch along McKinley Avenue from Millbrook Avenue to Clovis Avenue. Construction of Segment 4 is anticipated to begin Fall/Winter 2022.

 

On December 13, 2018, the City Council approved the Consultant Services Agreement, which was then executed on January 3, 2019, with Blair, Church, and Flynn Consulting Engineers, Inc. (Consultant), for the design of the Fresno Midtown Trail Project on the north bank of the Mill Ditch along McKinley Avenue from Millbrook Avenue to Clovis Avenue (Segment 4), and for the design of the Clovis Ave Metro Trail along the west side of Clovis Avenue from McKinley Avenue to Shields Avenue (Segment 5).

 

The City and Consultant executed the First Amendment on March 19, 2019, in the amount $18,600.00, for a rate increase to account for the elapsed time between the Consultant’s proposal submittal and the execution of the Consultant Agreement, for Segment 4 ($10,424.72) and Segment 5 ($8,175.28). The City and Consultant executed the Second Amendment on December 11, 2020, for ($6,745.00), for additional design services for Segment 5. The City and Consultant executed the Third Amendment on April 13, 2021, for ($4,655.00), for additional coordination and deliverables, needed to complete a utility liability determination for Segment 4.

 

Approval of the Fourth Amendment to the Consultant Services Agreement and authorization of the Public Works Director or designee to sign on behalf of the City, is necessary to address right-of-way finalization services, additional retaining wall design requirements, increased project duration, utility coordination, deliverables, and maintenance and operational requirements presented by the Fresno Irrigation District (FID), pursuant to the Master Trails Agreement, adopted by City Council on December 13, 2018. The cost of the Fourth Amendment is $55,400, increasing the total contract amount to $268,179.72 for Segment 4, and will be paid with local Measure “C” Trails funding.

 

The City Attorney has reviewed and approved the amendment as to form.

 

ENVIRONMENTAL FINDINGS

 

Based upon the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, this item does not qualify as a “project”.

 

LOCAL PREFERENCE

 

Local preference was not implemented because this is an amendment to an existing agreement.

 

FISCAL IMPACT

 

The cost of the Fourth Amendment to the Consultant Services Agreement, $55,400, increases the total contract amount to $268,179.72 for Segment 4, will be funded by local Measure C Trails funding, and has no impact on the City’s General Fund. The current fiscal year budget includes adequate appropriations to fund this contract amendment. The project is located in Council Districts 4 & 7.
