Actions pertaining to the Proposition 64 Health and Safety Grant Cohort 4 (Prop 64) Grant program:
1. Authorize the City Attorney’s Office to accept $1,440,788 in grant funding for the Proposition 64 Health and Safety Cohort 4 (Prop. 64) Grant awarded from the State of California, Board of State and Community Corrections (BSCC).

RECOMMENDATIONS
Staff recommends Council adopt the attached resolutions authorizing acceptance of $1,440,788 in grant funding from the State of California Board of State and Community Corrections (BSCC) for the Fresno City Attorney’s Office Prop 64 grant and authorizing the City Attorney or designee to sign all necessary acceptance and implementing documents and amending AAR No 2026-159 to appropriate $375,000 in Prop 64 grant funding into the FY 2027 budget for the City Attorney’s Office. The remaining funds will be utilized in future fiscal years.
EXECUTIVE SUMMARY
Grant funding is available through the State of California, Board of State Community Corrections (BSCC) for local enforcement efforts to address local impacts associated with the illegal cultivation and sale of cannabis. The City Attorney’s Office applied for and has been awarded Prop 64 grant funds in the amount of $1,440,788. The grant period is from July 1, 2026, to June 30, 2031.
BACKGROUND
The Prop 64 Grant Program was established in 2016 through the voter-approved Control, Regulate and Tax Adult Use of Marijuana Act. This cohort of awards was made in a variety of size-based categories with all projects addressing one or more of four cannabis-related focus areas: public safety/enforcement, youth prevention/intervention, public health, or environmental impacts.
The grant funds awarded will allow the City Attorney’s Office to expand existing enforcement activities addressing the eradication of illegal cannabis cultivation and illegal cannabis retail sales to improve health and safety throughout the City of Fresno, including through identification and enforcement of various hazards, land use, and zoning violations stemming from illegal cannabis activity.
Prop 64 grants require local agencies awarded funding to provide a resolution approved by their governing body authorizing contract execution, delegating signing authority, and acknowledging agreement to all grant contract terms.
ENVIRONMENTAL FINDINGS
This is not a project as defined by California Environmental Quality Act Guidelines Section 15378.
LOCAL PREFERENCE
Local preference is not applicable because these resolutions do not include a bid or award of a construction or services contract.
FISCAL IMPACT
Prop 64 grant funds will be used to expand existing enforcement activities without impacting the General Fund or City Attorney’s Office budget. Under the terms of the grant, approved expenditures are reimbursed to the City up to the maximum amount of award. Expenses will be claimed and reimbursed on a quarterly basis. The Prop 64 Grant program does not require the City to match funds.
