RECOMMENDATION
Staff recommends City Council adopt a Resolution authorizing the Director or Assistant Director of Public Utilities, or designee, to submit applications for payment programs to the California Department of Resources Recycling and Recovery (CalRecycle), and execute all documents necessary to implement and secure payment related to all available payment programs for which the City of Fresno is eligible.
EXECUTIVE SUMMARY
The adoption of the above Resolution will ensure the implementation and execution of the CalRecycle payment programs currently in progress and those which are of benefit to the City and its residents. This action will provide for a continuum of solid waste and recycling activities, including but not limited to outreach events, recycling activities, litter control, oil recycling, and other activities in which the Department of Public Utilities, Solid Waste Management Division is involved, and that funding expenditures are applied consistent with State requirements.
Adoption of the above resolution will authorize the Director or Assistant Director of Public Utilities, or designee, as the Signature Authority, to execute all documents necessary to implement and secure payment from CalRecycle. The authorization will be effective until rescinded by the Signature Authority or the City Council.
BACKGROUND
The Solid Waste Management Division has taken advantage of CalRecycle payment programs since 1994. Payment program funds are used each year to promote the importance of recycling of all products, waste minimization, litter abatement, and to support public education and community outreach. In Fiscal Year 2019, Solid Waste Management Division collection crews recycled 11,660 gallons of used motor oil and 17,850 filters through the City’s Residential Curbside Collection Program. The Solid Waste Management Division recycling program has made contact with over 16,500 residents during 49 community outreach events. Our educational events have made contact with 20 schools during 78 presentations and engaged with 2,695 students.
CalRecycle requires that jurisdictions, applying on their own behalf, adopt a resolution authorizing the submission of applications for CalRecycle payment programs and designating an individual with signing authority for the execution of related documents. On November 29, 2018, the City Council adopted Resolution No. 2018-270, authorizing the Department of Public Utilities, or designee, to execute all documents necessary to implement and secure payment from CalRecycle. Since adoption of that Resolution, CalRecycle has updated its required language concerning signing authority. CalRecycle now requires that the Council adopt a Resolution authorizing the Director or Assistant Director of Public Utilities, or designee, to execute all documents necessary to implement and secure payment. CalRecycle requires adoption of a resolution with this updated language prior to payment of additional payment program monies to the City.
ENVIRONMENTAL FINDINGS
Pursuant to the definitions provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, this is not a project for purposes of CEQA.
LOCAL PREFERENCE
Local preference was not implemented because the adoption of a resolution does not include a bid or an award of a construction or services contract.
FISCAL IMPACT
There will be no fiscal impact to the General Fund or any City operating funds associated with the recommended action. This project will benefit citywide.
