Approve a ten-year agreement with Bullard Cal Ripken for the use and maintenance of Figarden Loop Park baseball field

RECOMMENDATION

 

Staff recommends that the City Council approve the attached ten-year agreement with two five-year extensions with Bullard Cal Ripken, allowing priority access to the baseball field at Fig Garden Loop Park in exchange for maintenance services at Fig Garden Loop Park.

 

EXECUTIVE SUMMARY

Bullard Cal Ripken agrees to provide maintenance, landscaping and repair services for the Fig Garden Loop Park Baseball Field, in exchange for priority access to all baseball fields. The Agreement is for ten years, with the option of two five-year extensions. 

 

BACKGROUND

The Bullard Cal Ripken League (the League) was instrumental in the original overall planning of the Fig Garden Loop Park and they attended all of the community meetings, offered feedback and assisted with the ground-breaking in November 2008 and grand opening of the park in January 2010.  Since that time the League also agreed to fund the cost of maintaining the green space at the park.  While the City has been fortunate to have a partner who was willing to help in maintaining the park, the ongoing cost of maintenance has proven to be a financial strain on the League. 

 

Nevertheless, the League is still willing to fund the annual cost of maintaining the baseball field, which is estimated to be approximately $27,500 in exchange for priority access to the field.  The City would still benefit from this agreement considering that a year-long reservation of the baseball field would generate reservation fees for the City of approximately $4,800. Therefore, the City will continue receiving a higher value as the cost of maintaining the ball field is greater than the revenues generated by reservations. 

 

This agreement was reviewed and approved by the City Attorney and Risk Management Offices and includes the following terms:

 

Bullard Cal Ripken

                     Provide landscaping and grass-cutting services for the baseball field at Fig Garden Loop Park.  Perform necessary minor repairs to fences and gates around the baseball fields as needed, paying for all parts and labor. Provide and maintain the necessary equipment for baseball field operations, and replace the equipment as needed.

                     Maintain insurance, naming the City of Fresno as an additional insured, and also maintain an additional property insurance covering items of property kept at the fields.

                     Pay $2,000 annually to the City, which will be placed in a capital replacement reserve fund for the park.

                     Adhere to all watering restrictions and guidelines as per the City of Fresno Water Conservation Program.

The City

                     Provide Bullard Cal Ripken Baseball with priority registration for the use of the baseball field at Fig Garden Loop Park, Monday through Saturday between the months of May and October. The fields will be available on a first-come, first-served basis for the remainder of each year. The City of Fresno PARCS Department will coordinate through Bullard Cal Ripken with all other groups wishing to use the fields during such times when there is no Bullard Cal Ripken baseball functions scheduled.

                     Allow Bullard Cal Ripken the privilege of selling banners to hang around the outfield fences of the baseball fields in order to raise funds for their league.

                     Allow Bullard Cal Ripken to operate the snack bar and concessions at Fig Garden Loop Park, and retain all profits in order to fund maintenance expenses and other related costs.

 

ENVIRONMENTAL FINDINGS

A license agreement is not a project for the purposes of a California Environmental Quality Act.

 

LOCAL PREFERENCE

Local preference was not implemented because this item does not include the award of a construction or services contract.

 

FISCAL IMPACT

There is no immediate fiscal impact but it is anticipated that the cost of maintaining the green space surrounding the baseball diamond, which is estimated at approximately $14,400, will be included in Mayor Brand’s proposed Fiscal Year 2018 Budget
