RECOMMENDATIONS
Staff recommends the City Council (1) adopt a finding of Categorical Exemption pursuant to Section 15301, Existing Facilities (Class 1) of the California Environmental Quality Act (CEQA) Guidelines, (2) award a Construction Contract to Agee Construction Corp. of Clovis, California in the amount of $1,469,234.00 as the lowest responsive and responsible bidder and authorize the Capital Projects Director or designee to sign the Construction Contract on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The City of Fresno has identified the need to restore Cedar Avenue between Herndon Avenue and Alluvial Avenue to extend the service life of this heavily traveled arterial roadway. The project will use a combination of pavement rehabilitation methods, including grind-and-overlay and targeted full-depth pavement replacement. It will also support the City’s complete streets goals by adding buffered Class II bicycle lanes, installing ADA-compliant curb ramps, and modifying median noses at affected crosswalks. Additional improvements include replacing vehicle detection loops and upgrading signage and pavement striping.
Together, these upgrades will enhance safety and improve multimodal connectivity for motorists, cyclists, and pedestrians. Approval of the $1,469,234 Construction Contract awarded to Agee Construction Corp. of Clovis, California, will allow the project to proceed to the construction phase. The project is federally funded through Surface Transportation Block Grant (STBG) funds.
BACKGROUND
The City of Fresno Public Works Department has identified the need for pavement rehabilitation along a 0.6-mile segment of Cedar Avenue, between Herndon Avenue and Alluvial Avenue. In September 2021, the City applied for Surface Transportation Block Grant (STBG) funding to support the design, management, and construction of the Cedar Overlay Roadway Improvements.
The project will restore pavement along this segment of Cedar Avenue through a combination of grind-and-overlay work and targeted full-depth pavement replacement. It will also advance the City’s Complete Streets goals by narrowing travel lanes to add buffered Class II bicycle lanes, reconstructing curb ramps to meet ADA standards, and adjusting median noses at affected crosswalks. Additional improvements include replacement of vehicle detection loops and updating roadway signage and striping. Together, these upgrades will enhance safety and improve multimodal connectivity for motorists, cyclists, and pedestrians.
This project is federally funded through STBG funds.
The engineering design phase commenced following the City Council’s approval of a consulting services agreement with Peters Engineering Group in January 2024.
The Notice Inviting Bids for the project’s Construction Contract was published in the Fresno Business Journal and posted on the City’s website on March 2, 2026. Six (6) sealed bid proposals were received and opened in the public bid opening on March 31, 2026, with bids ranging from $1,469,234 to $1,667,070. Agee Construction Corp. of Clovis, California is deemed the lowest responsive and responsible bidder. The bids will expire on June 3, 2026, sixty-four (64) days after the bid opening. If the bids are rejected or expire, the project will be rebid resulting in a delay of approximately three (3) months.
The Community Workforce Agreement (PLA), adopted by City Council in September 2021, does not apply to this contract due to suspension of FHWA PLA approval in 2025.
Staff recommends the City Council (1) adopt a finding of Categorical Exemption pursuant to Section 15301, Existing Facilities (Class 1) of the California Environmental Quality Act (CEQA) Guidelines and (2) award a Construction Contract for the Cedar Overlay Roadway Improvements from Herndon Avenue to Alluvial Avenue to Agee Construction Corp. of Clovis, California in the amount of $1,469,234 as the lowest responsive and responsible bidder; and to authorize the Capital Projects Director or designee to sign and execute the contract on behalf of the City of Fresno.
The City Attorney’s Office has reviewed and approved the contract as to form.
ENVIRONMENTAL FINDINGS
Staff utilized an on call environmental consultant to perform an environmental assessment of this project and determined it falls within the Categorical Exemption set forth in CEQA Guidelines, Section 15301/Class 1 (minor alteration to existing facilities), which exempts the repair and maintenance of existing facilities that involves negligible or no expansion of an existing use.
The proposed project would be consistent with the provision of a Class 1 Categorical Exemption because it would be limited to the rehabilitation of existing pavement and replacement of failing segments of pavement to optimal conditions along an existing roadway segment in a developed portion of the City. The project would not increase the number of travel lanes or otherwise increase roadway capacity.
Based on the on call environmental consultant’s environmental assessment, it was determined that no adverse environmental impacts would occur because of the proposed project and none of the exceptions to the Categorical Exemptions set forth in the CEQA Guidelines Section 15300.2 apply to this project.
LOCAL PREFERENCE
Local preference was not implemented for this project because this project is federally funded, which precludes local preference.
FISCAL IMPACT
The Cedar Avenue Roadway Improvements between Herndon Avenue and Alluvial Avenue is in Council District 6. The overall cost of the project is $2,185,637 and is primarily funded by a federal grant from Surface Transportation Block Grant (STBG), with a local contribution of $282,400 through SB1 gas tax revenues. The project will not impact the General Fund. All funds necessary for the contract award are included in the current fiscal year budget as previously adopted by the Council.
