Approve Amendment One to the ordering document of the Software License and Services Agreements with Oracle, Inc., to remove license expansion fees for historical archive use of PeopleSoft financials and authorize the City Manager or designee to execute the agreement on behalf of the City.

RECOMMENDATION

 

Staff recommend the Council approve Amendment One to the ordering document of the Software License and Services Agreements, dated June 24, 1998, and March 24, 1999, with Oracle, Inc., to remove license expansion fees for historical archive use of PeopleSoft financials. The modifications remove further license expansion fees for PeopleSoft financials if it is used as an historical archive.  Staff request that Council allow the City Manager or designee to enter into the agreement.

 

EXECUTIVE SUMMARY

 

The City of Fresno is using PeopleSoft financials as an archive of financial information since the migration to Tyler Munis financials. Modifications to the Software License and Services Agreement, dated June 24, 1998, and March 24, 1999, with Oracle, will allow the City to use PeopleSoft financials as a historical archive without incurring further license expansion fees.

 

BACKGROUND

 

The City has used PeopleSoft for several years with the original Software License and Services Agreement, dated June 24, 1998, and March 24, 1999, with Oracle. That agreement included license expansion fees of $180,335 per each $100 Million of increase in the City’s annual budget. Following the most recent contractual obligation payment, the City and Oracle negotiated a change to the agreement to allow the City to operate PeopleSoft financials in an archive mode with no further expansion costs. Approval of these changes will eliminate further license expansion costs in the future.

 

ENVIRONMENTAL FINDINGS

 

By definition of the California Environmental Quality Act (CEQA) Guidelines Section 15378, the approval of this amendment is not a project defined by CEQA.

 

LOCAL PREFERENCE

 

Local preference is not applicable because this is an amendment to an existing contract. 

 

FISCAL IMPACT

 

The approved FY25 budget contains funding for this item.
