Title
Approve the Third Amendment to the Professional Consultant Services Agreement with Provost & Pritchard Engineering Group, Inc., to extend the Agreement from December 30, 2019, to June 30, 2020, to provide continued engineering support during construction of the Recycled Water Transmission Main along Madison Avenue, Valentine Avenue, Whitesbridge Avenue, and Brawley Avenue, with no change to the previously authorized contract amount of $438,744 (Council District 3 and Fresno County).

RECOMMENDATION
Staff recommends that the City Council approve a Third Amendment to the Consultant Services Agreement with Provost & Pritchard Engineering Group, Inc. (Provost & Pritchard), to extend the duration of the agreement to June 30, 2020, for the Recycled Water Transmission Main along Madison Avenue, Valentine Avenue, Whitesbridge Avenue, and Brawley Avenue (Project).
EXECUTIVE SUMMARY
Through a competitive selection process Provost & Pritchard was awarded a consultant services contract to provide engineering design, bidding support, and construction support for the Recycled Water Transmission Main along Madison, Valentine, Whitesbridge, and Brawley Avenues. The Third Amendment to the Agreement is for a time extension to provide continued engineering support during construction as made necessary by delays during the design process, which ultimately pushed the award of a construction contract, and activities out further than anticipated.
BACKGROUND
On September 28, 2017, the City Council awarded a Consultant Services Agreement to Provost & Pritchard for design of the Recycled Water Transmission Main along Madison, Valentine, Whitesbridge and Brawley Avenues. The agreement is a standard five-part contract consisting of Schematic Design, Design Development, Construction Documents, Bidding Support, and Construction Support phases. During the Design Development Phase, the Department of Public Utilities (DPU) opted to design approximately 1,300 feet of additional recycled water main improvements along Madison Avenue, east of Valentine Avenue as well as approximately 1,300 feet along Whitesbridge Avenue, west of Valentine Avenue in an effort to support recycled water connections to proposed residential developments. The additional recycled water main segments resulted in a cost increase of $18,437 and prompted the First Amendment to the Provost & Pritchard Consultant Agreement.
Additionally, during the Design Development Phase, DPU coordinated with a private residential developer working in the vicinity of the Project’s footprint to incorporate all future utilities as well as align the timing of construction in an effort to avoid multiple disturbances to street improvements. In time the developer’s schedule fell behind causing delays to the City of Fresno’s recycled water Project. As a result of the delays, a Second Amendment extending consultant services to December 30, 2019 was executed to allow for Project completion.
Following execution of the Second Amendment, further delays by the developer ultimately resulted in the City of Fresno deciding to move forward separately with its own Recycled Water Transmission Main Project. As a result of the change in direction some alterations to the plans were necessary. The combination of delays and revisions to plans ultimately pushed the anticipated conclusion of the Project to extend beyond the second amendment termination date of December 30, 2019. The Third Amendment extends the Consultant Agreement with Provost and Pritchard by six months, with a new termination date of June 30, 2020, to allow for continued engineering support throughout the life of the construction Project.
Upon approval by the City Council, the Third Amendment to agreement will be executed by the Director of Public Utilities, or his designee.
This Third Amendment has been approved as to form by the City Attorney’s Office.
ENVIRONMENTAL FINDINGS
Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(5), this is not a “project” for the purpose of CEQA, as this is an organizational or administrative action of the government to enforce an existing obligation, and will not result in a direct or indirect physical change in the environment.
LOCAL PREFERENCE
Local preference does not apply to this action because this is an amendment to an existing Consultant Services Agreement.
FISCAL IMPACT
This amendment has no financial impact on the General Fund. This Project is located in Council District 3 and a portion of Fresno County. Funds for the completion of this construction Project are budgeted in Fiscal Year 2020 and available in the Sewer Enterprise Fund 40501.
