Approve Contract Change Order No. 05 in the amount of $0.00 with American Paving Company of Fresno, California, which extends the date of completion to June 21, 2024 by increasing the contract time by twenty-two (22) additional working days, for the Fink-White Splash Play Area Project. RECOMMENDATION
Staff recommends that the City Council approve Contract Change Order No. 05 with American Paving Company for an increase in the contract time by twenty-two (22) additional working days and no increase in the contract amount related to equipment procurement delays at the Fink-White Splash Play Area and authorize the Capital Projects Director or designee to sign the contract change order on behalf of the City of Fresno.
EXECUTIVE SUMMARY
On December 15, 2022, a contract was awarded in the amount of $1,271,280.00 to American Paving Company of Fresno, California for the Fink-White Splash Play Area. City Council approval of Contract Change Order No. 05 in the amount of $0.00 and the addition of 22 working days of contract time is necessary due to the manufacturer delay with material and equipment procurement for equipment related to the water management system for the splash pad equipment necessary to construct the improvements.
BACKGROUND
On December 15, 2022, a contract was awarded in the amount of $1,271,280.00 to American Paving Company of Fresno, California for the Fink-White Splash Play Area. The Notice to Proceed was issued with a start date of October 10, 2023, with an original Contract Completion Date of February 21, 2024.
There have been four (4) prior Contract Change Orders approved totaling $90,049.36, resulting in a Revised Contract Price of $1,361,329.36. There have been thirty (30) days added to the Contract Time by previously executed Contract Change Orders and thirty-four (34) weather days added resulting in a Revised Contract Completion Date of May 21, 2024.
City Council approval of Contract Change Order No. 05 for an increase in the contract time by twenty-two (22) additional working days and no increase in the contract amount is required by Resolution 2017-158 (Resolution). The Resolution sets the approval thresholds for individual Contract Time extensions which by itself or aggregated with time increases under previous Contract Change Orders exceed 30 days or 20 percent (20%) of the total time allowed under the Contract, whichever is greater. The amount of aggregated Contract Change Order days, including Change Order No. 05, is a total of 52 days, which exceeds both the 30 days and 20% of Contract time thresholds.
Due to delivery delays with material and equipment for the water management system associated with the splash pad equipment, an additional twenty-two (22) working days are to be credited to the Contractor which will extend the date of Contract Completion to June 21, 2024.
The project is now substantially complete and the scope of work for the project included removing the existing wader pool and constructing a splash play area and associated utility and accessible path improvements. The project is fully funded with Community Development Block Grant (CDBG) funds and Measure P revenues.
ENVIRONMENTAL FINDINGS
Staff performed a preliminary environmental assessment of this project and determined that it falls within the Categorical Exemption set forth in CEQA guidelines, Section 15301(d)/Class 1 (Existing Facilities) and 15302/Class 2 because the project includes no expansion of an existing use.
A finding of Categorical Exemption was adopted by Council on December 15, 2022, as part of the contract award.
LOCAL PREFERENCE
Local preference was not implemented for this project due to it being funded through a Federal Community Development Block Grant, however the contractor is local to Fresno.
FISCAL IMPACT
The Fink-White Splash Play Area Project is in Council District 3. The project is funded with federal CDBG and Measure P funds from category one, “Improving and Maintaining Safe, Clean Neighborhood Parks and Playgrounds.” The project will have no impact to the General Fund.
