Approve First Amendment to Agreement with Jeff Katz Architecture adding $44,000 for a total of $509,000 for the Fire Station No. 18 project (Council District 1).

RECOMMENDATIONS
Staff recommends that Council approve the First Amendment to Agreement with Jeff Katz Architecture (JKA) in the amount of $44,000 for the Fire Station No. 18 project and authorize the Public Works Director or his designee to sign and execute the standard first amendment on behalf of the City of Fresno.
EXECUTIVE SUMMARY
Additional compensation is appropriate for the architectural firm for Fire Station 18, due to changes that were necessary in the overall design of the project. Due to the final square footage of the new Fire Station No. 18 and Building Code re quirements, commissioning of all systems is required. Consequently a Commissioning Agent was retained by the consultant to perform all mandatory commissioning activities and reports, a service not included in the original contract. The design of the fire station was also modified to create long-term benefits for the Fire Department by ensuring compatibility with future Shaw Avenue storm drain systems and enabling on-site temporary ponds to be backfilled in the future, creating long-term value for the City. This required the lowering of the entire site and the finish floor grades of the fire station itself. The additional compensation to the consultant was anticipated in the overall project budget at time of contract award.
BACKGROUND
On July 28, 2016 Council approved an agreement with Jeff Katz Architecture of San Diego, CA in the amount of $465,000 with a contingency amount not to exceed $15,000 for the design of plans, cost estimates and general construction documents for the Fire Station No. 18 project. During the plan check process and review of applicable Building Code requirements, it was determined that due to the size of the building Commissioning is required. Therefore, a Commissioning Agent has been retained by JKA to perform all necessary inspections, tests and provide required approvals and final reports.
The original design did not take into account future Shaw Avenue off-site improvements and their corresponding grades, since the Shaw Avenue Official Plan Line had not yet been adopted. An overall lowering of the site as well as the finish floor grades of the station itself was necessary which required additional architectural, civil engineering along with structural, electrical and plumbing engineering. These changes are extremely beneficial to the Fire Department, so as to create the ability for the required temporary on-site drainage systems to be backfilled in the future and enable full use of the property. The Fire Station 18 site will also be compatible through these changes with future Shaw Avenue street grades, in conformance with the Fresno Metropolitan Flood Control District master plan, so as to allow for smooth ingress and egress to the property in the future.
To accommodate these required revisions, the Public Works Department is requesting the approval of the first amendment to the agreement with JKA and the authorization of the Public Works Director or his designee to sign and execute the first amendment to agreement on behalf of the City of Fresno. The first amendment to agreement is to retain a Commissioning Agent through JKA and re-design the site to meet the grades of the future off-site improvements for the new Fire Station No. 18 for a total fee of $44,000.
The First Amendment to Agreement has been approved as to form by the City Attorney’s Office.
ENVIRONMENTAL FINDINGS
Design of plans is not a “project” pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378.
LOCAL PREFERENCE
Not applicable for this amendment for services which could only be performed by the architect of record.
FISCAL IMPACT
All costs associated with this amendment are included in the adopted budget for the Fire Station 18 capital project.
