RECOMMENDATION

 

Staff recommends that the City Council award a construction contract in the amount of $449,289, to Harris Development Corp. dba HBC Enterprises, of Clovis, California, as the lowest responsive and responsible bidder for the Cary Bleacher and ADA Improvements Project (Project) and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno (City).

 

EXECUTIVE SUMMARY

 

The Capital Projects Department seeks to award a construction contract to Harris Development Corp. dba HBC Enterprises following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $449,289 for the Cary Bleacher and ADA Improvements Project. The Project will construct accessibility and seating improvements to enhance guest experience, safety, and accessibility at Cary Park. The scope of work includes the construction of an accessible path of travel, new bleachers, and drinking fountains at and around the existing baseball fields at Cary Park. The construction contract will utilize Fiscal Year (FY) 2025 American Rescue Plan Act (ARPA) and Measure P, Category 1 Citywide appropriations.

 

BACKGROUND

 

The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) proposes to construct accessibility and seating improvements to enhance park guest experience, safety, and accessibility at Cary Park located on the southeast corner of Santa Ana Avenue and Fresno Street. The scope of work includes the construction of an accessible path of travel, new bleachers, and drinking fountains at and around the existing baseball fields. Pursuant to these goals, The City entered into an agreement with Lars Andersen & Associates on November 17, 2022, for design and preparation of construction documents for the Project.

 

A Notice Inviting Bids was advertised and published on the City’s website, Planet Bids, and the Business Journal on August 2, 2024. The Project plans and specifications were distributed to thirty-four (34) prospective bidders and posted at seven (7) Building Exchanges. Four (4) sealed bid proposals were received and opened in a public bid opening on August 27, 2024. One (1) of the four (4) bid proposals received withdrew their bid post bid opening.  Final bids received ranged from $449,289 to $631,216. The bids will expire on October 30, 2024. If the bids are rejected or expire, the Project must be rebid, which will result in a delay to the Project.

 

The Community Workforce Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this Project was less than $1 million, pursuant to the terms of the PLA.

 

Staff now recommends Council award a construction contract to Harris Development Corp. dba HBC Enterprises, of Clovis California, in the amount of $449,289, as the lowest responsive and responsible bidder, and authorize the Capital Projects Director or designee to sign and execute the standardized construction contract on behalf of the City of Fresno.

 

The City Attorney’s Office has reviewed and approved the standardized construction contract as to form.

 

ENVIRONMENTAL FINDINGS

 

Staff performed an environmental assessment of this Project and determined that it falls within the Categorical Exemption set forth in CEQA guidelines, Section(s) 15301/Class 1 and 15302/Class 2 because the Project includes minor alterations to existing facilities and shall replace existing structures and facilities, with new structures located on the same site as the structure replaced and will have substantially the same purpose and capacity.

 

Categorical Exemption determined by staff has been filed with the Fresno County Clerk’s Office pursuant to the requirements of CEQA Guidelines Section 15062(c)(2), as of March 27, 2024.

 

LOCAL PREFERENCE

 

Local preference was not implemented because of federal ARPA funding.

 

FISCAL IMPACT

 

The Cary Bleacher and ADA Improvement Project is in Council District 4 and will have no impact to the General Fund. The Project will be funded utilizing Fiscal Year 2025 American Rescue Plan Act and Measure P, Category 1 Citywide appropriations.
