RECOMMENDATION

 

Staff recommends that Council adopt a resolution dedicating those portions of City-owned property for public utility purposes to accommodate the construction of public utilities at the newly named Carnegie Library Garage and formally known as North Fulton Street Parking Structure Project.

 

EXECUTIVE SUMMARY

 

The Capital Projects Department (CPD) is in the process of constructing Phase Two of the Carnegie Library Garage, located on an existing City-owned and operated parking lot, bounded by Tuolumne Street, Broadway Street, Congo Alley, and the approved Merced Street Extension Project. This project requires new utility facilities to be installed in order for this project to be energized.  The dedication of this public utility easement will provide the area for these new facilities to be constructed.

 

BACKGROUND

 

On November 20, 2025, the City Council approved Amendment No. 2 to the Progressive Design-Build Agreement with Bomel Construction Company, Inc., to provide design and construction services related to the North Fulton Parking Structure Project in an amount not to exceed $35,323,776.00, bringing the total contract amount to $37,278,435. The project will provide more than 600 parking stalls in Downtown Fresno. Construction is proceeding well and the topping-off ceremony was recently held on the parking structure. This project requires new utility facilities to be installed in order for this project to be energized.  This public utility easement will provide the area for these new facilities to be constructed.

 

The City Attorney’s Office has reviewed and approved the attached Resolution as to form.

 

ENVIRONMENTAL FINDINGS

 

The North Fulton Parking Structure Project is found to have been previously analyzed within the Environmental Impact Report (EIR) published for the Fulton Corridor Specific Plan (FCSP), Downtown Neighborhoods Community Plan (DNCP), and Downtown Development Code (DDC) in July of 2016. After review of the EIR, it was determined that the parking structure does not have any significant environmental impact beyond what was previously analyzed. A Consistency Determination has been drafted to show this project’s consistency with the goals and environmental mitigation measures of the FCSP, DNCP, DDC, and associated EIR in accordance with CEQA Section 15183.

 

LOCAL PREFERENCE

 

Local preference was not implemented because the dedication of a public utility easement does not involve bid or award of a construction or services contract.

 

FISCAL IMPACT

 

The North Fulton Parking Structure Project is in Council District 3 and will have no impact on the General Fund. The amendment is fully funded by the State of California via the Downtown Fresno Public Infrastructure Improvement Projects Grant and the Infill Infrastructure Grant Program FY26 and 27 appropriations which includes the construction of all new public utilities.
