Reject all bids received for the Paul “Cap” Caprioglio Community Center Remodel Project. (Bid File No. 12403201) (Council District 4)

RECOMMENDATION

 

Staff recommends that the City Council reject all bids received for the Paul “Cap” Caprioglio Community Center Remodel Project (Project) and direct staff to re-bid the Project.

 

EXECUTIVE SUMMARY

 

Staff recommends that the City Council reject all bids received for the Paul “Cap” Caprioglio Community Center Remodel Project. The two bids received ranged from $1,325,800 to $2,450,000 which represented seven percent (7%) below the funding allocation for the Project and one-hundred seventy-one percent (171%) above the funding allocation, respectively. However, upon evaluation of the bids, it is staff’s determination that both bidders are non-responsive due to missing and/or incomplete information required at the time of bid opening. Upon rejection of all bids received, staff will re-bid the Project immediately.

 

BACKGROUND

 

The City entered into an agreement with Temple-Andersen-Moore Architects, LLP., dated August 27, 2020, for the design and preparation of construction documents for improvements to the south building at Paul “Cap” Caprioglio Community Cener including, but not limited to, removal and replacement of the heating, ventilation, and air conditioning (HVAC) system, accessibility and energy efficiency improvements, and reconfiguration of the existing space to optimize future programs and activities.

 

The Notice Inviting Bids was advertised and published in the Business Journal, Planet Bids, and posted on the City’s website on July 19, 2024. Ten (10) building exchanges received the Notice Inviting Bids. The specifications were distributed to forty (40) perspective bidders, two (2) sealed bid proposals were received and opened in a public bid opening on August 13, 2024, with bids ranging from $1,325,800 to $2,450,000. Upon evaluation of the bids received, staff determined that both bidders were non-responsive due to missing and/or incomplete information required at the time of bid opening, including but not limited to missing subcontractor information and incomplete or missing Department of Industrial Relations information for proposed subcontractors. Staff now recommends that the City Council reject all bids received for the Paul “Cap” Caprioglio Community Center Remodel Project and direct staff to re-bid the Project. The bids will expire on October 16, 2024.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act (CEQA) Guidelines, Section 15378, the rejection of bids does not qualify as a “project” as defined by the CEQA requirements.

 

LOCAL PREFERENCE

 

Local preference was not considered as this is an action recommending the rejection of all bids.

 

FISCAL IMPACT

 

The Paul “Cap” Community Center Remodel Project is in Council District 4 and will have no impact to the General Fund. The Project will be funded with Measure P allocations adopted in the FY25 Budget.
