Award a consultant services agreement to Omni Design, Inc., of San Luis Obispo, California, for an amount not to exceed $207,728 for the Design of Materials Storage Buildings at the Fresno-Clovis Regional Wastewater Reclamation Facility’s (Council District 3).

RECOMMENDATION
Staff recommends that City Council award a consultant services agreement to Omni Design, Inc., of San Luis Obispo, California, for an amount not to exceed $207,728, inclusive of a $18,885 contingency, for the Design of Materials Storage Buildings at the Fresno-Clovis Regional Wastewater Reclamation Facility (RWRF); and authorize the Director of Public Utilities, or designee, to sign the agreement on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
The RWRF requires additional canopies to properly house heavy equipment vehicles and the construction of various improvements to existing warehouse buildings to accommodate materials and tools. The selected consultant will prepare plans and specifications for construction and provide support during bidding and construction for a total amount not to exceed $207,728, which includes a contingency amount of $18,885.
BACKGROUND
The Wastewater Management Division (WMD) is responsible for the collection, conveyance, treatment, and reclamation of wastewater generated by the residential, commercial, and industrial sewer customers in the Fresno-Clovis metropolitan area. All the heavy equipment vehicles used in the maintenance and repair of WMD assets no longer fit under the existing prefabricated steel canopy buildings and RWRF requires additional canopies to protect and house these City assets. WMD seeks to (1) build two new prefabricated steel canopy buildings, (2) improve existing storage buildings to properly store used and recovered parts, (3) retrofit an existing canopy building to provide sufficient space to wash equipment and vehicles, and (4) design a centralized, WMD electronic waste and used oil containment structure to safely store the waste until proper disposal.
In accordance with Fresno Municipal Code Chapter 4, Article 1, and Administrative Order 6-19, the Department of Public Utilities conducted a competitive process for selecting a consultant to provide the requested professional services for this project. On February 17, 2023, a Request for Proposals was published in the Business Journal and posted on the City’s Planet Bids website. On March 23, 2023, one sealed proposal was received from Omni Design, Inc. A selection committee, consisting of representatives from WMD, and the Utilities Planning and Engineering division evaluated the proposal. Upon review of the qualifications for meeting the various criteria and analysis of the proposed fee, -Omni Design, Inc., was ultimately selected based on having met the criteria of the evaluation. Staff recommends award of a consultant services agreement to Omni Design, Inc., for a total amount not to exceed $207,728, which includes a contingency amount of $18,885. Funding for this project is included in the Fiscal Year 2023 Wastewater Enterprise Fund 40501.
A standardized consultant service agreement approved as to form by the City Attorney’s Office has been used in accordance with Administrative Order 4-4, and the consultant’s Certificates of Insurance have been approved by the City’s Risk Management division. Upon approval by the City Council, the consultant service agreement will be executed by the Director of Public Utilities, or designee.
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, the award of this Consultant Services Agreement to provide design services is not a “project” for the purposes of CEQA.
LOCAL PREFERENCE
Local preference was not implemented as the sole bidder is located outside of Fresno area.
FISCAL IMPACT
There is no impact to the General Fund. This project is located within Council District 3. Funding for this project is included in the Fiscal Year 2023 Wastewater Enterprise Fund 40501.
