RECOMMENDATION

 

It is recommended that Council adopt the Thirteenth Amendment to the Fiscal Year 2025 Salary Resolution No. 2024-120 as follows:

                     Exhibit 1, Non-Supervisory Blue Collar (Local 39) - amend the exhibit to correct the salary ranges for Senior Water Treatment Plant Operator and Water Treatment Plant Operator;

                     Exhibit 3, Unit 3, Non-Supervisory White Collar (FCEA) - amend the exhibit to modify the salary step plan range for the classifications of Administrative Clerk I, Senior Secretary and Staff Assistant, and deleting the classification of Secretary, effective February 24, 2025; and

                     Exhibit 16, Benchmark of Deleted Job Classifications or Deleted Pay Step since 1/28/16 - amend the exhibit by adding the deleted classification of Airport Public Safety Supervisor (310003) and its respective benchmark classification, effective July 1, 2024, and adding the deleted classification of Secretary and its respective benchmark classification, effective February 24, 2025.

 

EXECUTIVE SUMMARY

 

The City and Local 39 reached a tentative agreement in June 2023 on a successor MOU which replaced the MOU that expired on January 1, 2023. After implementation of the successor MOU which provided for an agreement retroactive from January 2, 2023 through June 15, 2025, it was recently discovered that one of the provisions was inadvertently applied on July 3, 2023, rather than on January 2, 2023. The City intends to correct this by amending the Senior Water Treatment Plant Operator and Water Treatment Plant Operator salary ranges in Exhibit 1 and providing retroactive pay to the current employees in these classifications.

 

The Personnel Services Department is updating the A-step in the salary step plan for the Administrative Clerk I job classification consistent with California's minimum wage standards.  The A-Step for Administrative Clerk I is below $16.50 per hour and will be adjusted from $2853 per month to $2860 per month, accordingly. 

 

In addition, the City intends to revise the salary ranges for Senior Secretary and Staff Assistant to align with the Secretary salary range.  The Senior Secretary and Staff Assistant salary ranges have inadvertently fallen behind the Secretary salary range and will be adjusted from $4103 - $4928 for Senior Secretary and $4109 - $4929 for Staff Assistant to $4120 - $4944 per month.  Consistent with this change, this City intends to delete the Secretary classification as it has become an obsolete position.

 

Finally, the deleted classifications of Airport Public Safety Supervisor, job code 310003, and Secretary, job code 110050, are being benchmarked and added to Exhibit 16, Benchmarked Deleted Job Classifications or Deleted Pay Step, Since 1/28/16, in order to establish a pay relationship for the purposes of calculating retirement benefits for any incumbent with qualifying service in the deleted class.

 

Amending Exhibit 1 will result in an estimated retroactive pay of $0 to the General Fund and $39,926 to All Funds for the current employees in these classifications and will not require additional appropriations. Amending Exhibit 3 to increase the Administrative Clerk I, A Step will not require additional appropriations.  Amending Exhibit 3 to increase the Senior Secretary and Staff Assistant salary ranges results in a cost of $1,129 to the General Fund and $2,250 to All Funds for the remaining Fiscal Year 2025 and will not require additional appropriations.  Amending Exhibit 16 will not require additional appropriations.

 

The City has provided notice to the respective bargaining units and has met its meet and confer obligation.

 

BACKGROUND

 

Exhibit 1, Non-Supervisory Blue Collar (Local 39) amendment

 

The City and Local 39 reached an agreement on a successor MOU on June 1, 2023. Members of the Unit ratified on June 20, 2023 and Council approved the successor MOU on June 29, 2023 which provided for an agreement from January 2, 2023 through June 15, 2025, increases to wages, and other changes in terms or conditions of employment.

 

After implementation of the successor MOU, it was recently discovered that the provision to incorporate the $375 per month Surface Water Treatment Facility site pay into the base wages for Senior Water Treatment Plant Operator and Water Treatment Plant Operator was inadvertently applied on July 3, 2023, rather than on January 2, 2023. The City intends to correct this by amending the Senior Water Treatment Plant Operator and Water Treatment Plant Operator salary ranges in Exhibit 1 and providing retroactive pay to the current employees in these classifications.

 

Exhibit 3, Unit 3, Non-Supervisory White Collar (FCEA) amendment

 

The Administrative Clerk I classification at the A Step has a starting salary of $2,853 monthly.  Consistent with the State of California increasing minimum wage to $16.50 hourly, it is recommended to increase the A Step from $2,853 to $2,860 monthly which equates to $16.50 per hour.  There are currently no incumbents at the Administrative Clerk I, A Step.

 

Over time, the Senior Secretary and the Staff Assistant salary ranges have fallen behind the Secretary classification.  It is recommended to align the Senior Secretary and Staff Assistant salary ranges to $4120 - $4944 monthly consistent with the current Secretary salary range and delete the Secretary classification.  At this time, there is only one (1) incumbent in the Secretary classification that will be reclassified to Senior Secretary. 

 

Exhibit 16, Benchmark of Deleted Job Classifications or Deleted Pay Step since 1/28/16 amendment

 

Consistent with Fresno Municipal Code Section 3-205 - Deletion of Classes, the City must benchmark job classification that are recommended for deletion by establishing a pay relationship for the purposes of calculating retirement benefits for any incumbent with qualifying service in the deleted class.  Classifications that are recommended to be benchmarked include the Airports Public Safety Supervisor (job code 310003) and the Secretary (job code 110050). 

 

The Airport Public Safety Supervisor (job code 310003) classification only applied to incumbents hired prior to July 1, 2010 and there are no current incumbents in this job classification.  This job code was eliminated when Unit 11, FAPSOA MOU was approved on July 1, 2024.

 

The Secretary classification is recommended to be benchmarked as the majority of positions in this series are filled at the Senior Secretary level, which has in turn made the Secretary level become obsolete. 

 

The City has provided notice to the respective bargaining units and has met its meet and confer obligation.

 

The City Attorney’s Office has approved the Thirteenth Amendment to Salary Resolution No. 2024-120 as to form.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a “project” and is therefore exempt from the California Environmental Quality Act requirements.

 

LOCAL PREFERENCE

 

Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno.

 

FISCAL IMPACT

 

Amending Exhibit 1 will result in an estimated retroactive pay of $0 to the General Fund and $39,926 to All Funds for the current employees in these classifications and will not require additional appropriations.
