RECOMMENDATION

 

Staff recommends that City Council approve the Second Amendment to the Consultant Services Agreement (Agreement) with Provost & Pritchard Consulting Group (Consultant) of Fresno, California, to increase the total contract by an amount not to exceed $43,800 paid on a time and materials basis, and add an additional contingency amount not to exceed $11,000, for a revised total contract amount not to exceed $259,786 paid on a time and materials basis and a revised contingency amount not to exceed $31,000, and extend the term of the agreement to December 31, 2028, for additional services needed to complete the Consultant’s scope of services, for the Wellhead Treatment Improvements at Pump Station 102A Project (Project), and authorize the Capital Projects Director or designee to sign and execute all documents on behalf of the City of Fresno (City).

 

EXECUTIVE SUMMARY

 

On June 10, 2022, the City approved a Consultant Services Agreement with Provost & Pritchard Consulting Group, to provide consulting services for the Project. The original scope of services included project management, engineering design services, bid support and construction support services. Following execution of the original Agreement, the City and Consultant entered into a First Amendment to the Consultant Services Agreement dated December 31, 2024. The First Amendment extended the term of the Agreement from December 31, 2024, to December 31, 2026.

 

Staff now recommends approval of the Second Amendment to the Consultant Services Agreement to revise the plans to include all pertinent information that will be needed for all equipment to be contractor-furnished, incorporate updated City design preferences into the standard vessel design details and technical specifications, prepare bid item descriptions, updated cost estimates and schedules resulting from these changes, and to extend the term of the Agreement to December 31, 2028. The Second Amendment to the Agreement will be funded utilizing appropriations included in the Fiscal Year 2026 Capital Improvement Budget within the Water Enterprise Fund.

 

BACKGROUND

 

The City maintains a water supply network consisting approximately 1,900 miles of water distribution pipelines, and more than 270 municipal groundwater production wells.  There are currently approximately 30 well sites with wellhead treatment systems that treat regulated contaminants or naturally occurring compounds that affect taste or impart odor.

 

On June 10, 2022, the City and the Consultant entered into an Agreement for an amount not to exceed $215,986 paid on a time and materials basis, with a contingency amount not to exceed $20,000, for professional consulting services including engineering design, bidding and construction support to install wellhead treatment facilities at Pump Station 102A. Due to a procurement requirement, the City and Consultant entered into the First Amendment to the Agreement on December 31, 2024, to extend the term of the Agreement to December 31, 2026, at no additional cost. Additionally, the City decided to revise procurement of wellhead treatment facilities equipment from an owner furnished, contractor installed approach to a contractor furnished and installed approach.

 

Staff now recommends approval of the Second Amendment to the Consultant Services Agreement to increase the total contract by an amount not to exceed $43,800 and increase contingency by an amount not to exceed $11,000, increasing the total contract to an amount not to exceed $259,786 paid on a time and materials basis in accordance with the Consultant’s updated schedule of fees, with a revised contingency amount not to exceed $31,000, and authorization of the Capital Projects Director or designee to sign the Second Amendment on behalf of the City. This Second Amendment includes Consultant services to revise the plans to include all pertinent information that will be needed for all equipment to be contractor-furnished, incorporate updated City design preferences into the standard vessel design details and technical specifications, prepare bid item descriptions, updated cost estimates and schedules resulting from these changes. Additionally, the Second Amendment will extend the term of the Agreement from December 31, 2026, to December 31, 2028. The Second Amendment will be funded utilizing appropriations included in the Fiscal Year 2026 Capital Improvement Budget within the Water Enterprise Fund. 

 

The City Attorney’s Office has reviewed and approved the proposed Amendment as to form.

 

ENVIRONMENTAL FINDINGS

 

Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, the Amendment of this Consultant Services Agreement for design services does not qualify as a “project” for the purpose of CEQA.

 

LOCAL PREFERENCE

 

Local preference does not apply to this action because this is an Amendment to an existing Consultant Services Agreement.

 

FISCAL IMPACT

 

The proposed Project is located in Council District 5 and has no impact to the General Fund. Funding for this Project is included in the Fiscal Year 2026 Capital Improvement Budget within the Water Enterprise Fund.
