RECOMMENDATION

 

Staff recommends that the City Council award a construction contract to Agee Construction Corporation of Clovis, California, in the amount of $4,809,694, as the lowest responsive and responsible bidder for the Peach Avenue Widening Project from Butler Avenue to Florence Avenue, and authorize the Capital Projects Director or designee to sign the construction contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The City of Fresno seeks to widen and construct street improvements along Peach Avenue between Butler Avenue and Florence Avenue, transforming it from two lanes into a four-lane arterial. This project will involve construction of median landscaping, protected left-turn lanes, bike lanes, curb and gutter, sidewalk and installation of a traffic signal. This widening project will enhance mobility by increasing capacity along Peach Avenue between Butler Avenue and Florence Avenue. The proposed action entails awarding a construction contract to Agee Construction Corporation in the amount of $4,809,694. This Project is funded by local Measure C and local developer impact fees.

 

BACKGROUND

 

In November 2006, voters approved a 20-year extension of Measure C, the half-cent sales tax for transportation. On January 27, 2009, the Council adopted Resolution No. 2009-19 in support of the proposed Measure C Short-Term Regional Transportation Program. The program and its associated handbook received approval from the Council of Fresno County Governments (FCOG) on January 29, 2009, and subsequently from the Fresno County Transportation Authority (Authority) on February 18, 2009. On December 16, 2009, the City and the Authority entered into a Measure C Cooperative Project Agreement for Project I-2 Peach Avenue Widening from Jensen Avenue to Butler Avenue, which provided funding for preliminary engineering. In 2014, due to funding availability, the project was divided into two phases: Phase 1 covers the stretch from Butler Avenue to Florence Avenue, and Phase 2 covers the segment from Florence Avenue to Jensen Avenue. Phase 2 will be completed as funding becomes available and/or development occurs. Construction funding for Phase 1 was then added by Amendment No. 1, executed on October 28, 2020, and further supplemented by Amendment No. 2, executed on April 19, 2023. Additionally, the City will fulfill its commitment to using Local Development Impact Fees to provide a 20% match for the remaining construction phase funding.

 

The Peach Avenue Widening Project between Butler Avenue and Florence Avenue, which is Phase 1 of Project I-2, will widen Peach Avenue from two lanes to four lanes and construct street improvements between Butler Avenue and Florence Avenue. The project will include construction of median landscaping, protected left-turn lanes, bike lanes, curb and gutter, sidewalk and installation of a traffic signal. This widening project will enhance mobility by increasing capacity along Peach Avenue between Butler Avenue and Florence Avenue.

The Notice Inviting Bids was published in the Business Journal on June 09, 2023, and posted on the City's website. Six bid proposals were received and opened during a public bid opening on September 05, 2023, with bid amounts ranging from $4,726,352 to $5,333,295. Jim Crawford Construction, the lowest apparent bidder, has withdrawn their bid, resulting in Agee Construction Corporation being deemed the lowest responsive and responsible bidder. The apparent low bid price was 2% below the Engineering Estimates. The bids are set to expire on November 8, 2023, which is 64 days after the bid opening.

Staff recommends awarding a construction contract to Agee Construction Corporation of Clovis, CA in the amount of $4,809,694 to carry out the widening and the construction of street improvements along Peach Avenue between Butler Avenue and Florence Avenue, as the lowest responsive and responsible bidder, and to authorize the Capital Projects Director or designee to sign the standardized agreement on behalf of the City of Fresno. This agreement is covered by the Community Workforce Agreement (PLA), adopted by the Council in September 2021. The contractor shall become a signatory to the PLA by executing the Agreement to Be Bound.

The City Attorney’s Office has reviewed and approved the standardized construction contract as to form.

ENVIRONMENTAL FINDINGS

 

A Mitigated Negative Declaration (MND) was adopted by the City Council on August 27, 2020 and filed with the County of Fresno on August 28, 2020.

 

LOCAL PREFERENCE

 

Agee Construction Corporation of Clovis, California, is a local business, as defined by the Fresno Municipal Code.

 

FISCAL IMPACT

 

The Peach Avenue Widening Project from Butler Avenue to Florence Avenue (Phase1) is located in Council District 5.  The overall cost of the project is $7,418,854 and is funded by local Measure C, local developer impact fees, and a small contribution from Fresno Metro Flood Control District for district related facilities improvements. Out of the overall budget, $4,809,694 will be allocated for the construction contract award. All funds required for the contract award are included in the current fiscal year budget, as previously adopted by the Council. The project will have no impact on the General Fund.
