RECOMMENDATION
Staff recommends City Council approve an increase to the Cooperative Purchase Agreement requirements contract between the City of Fresno (City) and Toter, LLC. (Supplier), increasing the contract amount by $300,000 per year for a total contract amount not to exceed $1,251,500 per year for the purchase of refuse, recycling, and green waste/organics containers as well as the kitchen countertop organic pails.
EXECUTIVE SUMMARY
The Department of Public Utilities (DPU), Solid Waste Management Division (SWMD) seeks to increase the spending authority to cover the cost of additional refuse, recycling and green waste/organics containers, as well as the kitchen countertop organic pails to maintain an adequate inventory and continuity of service. The purchase of kitchen countertop organic pails will be included in this increase using Cal Recycle SB 1383 Local Assistance Grant funds to distribute and purchase the kitchen countertop organic pails to residential customers. Staff recommends City Council approve an increase to the Cooperative Purchase Agreement requirements contract between the City and Supplier increasing the contract amount by $300,000 per year for a total contract amount not to exceed $1,251,500 per year for the next two (2) years.
BACKGROUND
On August 24, 2023, the City Council awarded a Cooperative Purchase Agreement between Toter, LLC., and the City for $951,500 annually based on a competitive bid contract with Sourcewell. This
amount includes sales tax and freight charges. The DPU-SWMD seeks to increase the spending authority for refuse, recycling, and green waste/organics containers as well as the kitchen countertop organic pails to maintain adequate operations inventory and continuity of service.
Additionally, in accordance with SB 1383 regulations, this will meet the requirement that jurisdictions conduct education and outreach on organics recycling to all residents, using the kitchen countertop organic pails as a tool to aid in a successful organic waste diversion program in the home.
On average, SWMD purchases a combined total of approximately 14,000 containers annually. Based on current growth trends, and the high number of damaged, stolen, and unrepairable containers, container inventory levels are below the threshold that has been established to prevent delays in service requests. To reestablish inventory levels above the threshold, SWMD is recommending an increase in acquisition to keep up with the growth of the City, maintain or increase replacement levels of stolen or damaged containers, and to provide the kitchen countertop organic pails as part of the SB1383 organics recycling education for residential customers.

ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, the extension of this contract does not qualify as a "project" as defined by CEQA.
LOCAL PREFERENCE
Local preference is not applicable.
FISCAL IMPACT
No general funds will be used to purchase these items. Funding is available in the approved FY 2025 Solid Waste Enterprise Fund (4100-4101). Funding for the organic kitchen countertop organic pails is available in the approved FY 2025 Budget under the SB 1383 Local Assistance Grant (fund 4100-4114).
