Approve a third amendment to agreement with CDM Smith Inc. in the amount of $265,600 for the third year of Groundwater Monitoring and Reporting at the Fresno Sanitary Landfill and authorize the Public Works Director or his designee to execute the agreement on behalf of the City.
 
EXECUTIVE SUMMARY
 
In June 1998, the City of Fresno entered into an agreement with the Environmental Protection Agency (EPA) to conduct the final cleanup at the Fresno Sanitary Landfill.  As part of the cleanup efforts, groundwater testing is required and quarterly and yearly reports on the cleanup effort are to be prepared for the EPA.  The proposed third amendment to agreement with CDM Smith Inc. is for ongoing groundwater monitoring and reporting to the EPA.  It is anticipated the department will return next year with an RFQ for a new agreement.
 
BACKGROUND
 
In June 1998, The City of Fresno entered into an agreement with the EPA to conduct the final cleanup of the Landfill.  The ongoing cleanup efforts require operation and maintenance activities at the groundwater extraction and treatment facility, groundwater monitoring and reporting, and negotiations with EPA.
 
On June 26, 2000, the City of Fresno began the construction of the Landfill Cap and installation of extraction wells and monitoring wells.  The construction also included a groundwater treatment facility and a Landfill gas flare.  Since that time, the City has been monitoring the groundwater plume using the monitoring wells in the area and wells installed on-site.
  
On March 28, 2011 per Administrative Order 6-19, Public Works staff mailed out and posted on the City's website, a notice requesting a RFQ from consultants with previous EPA experience with closed landfills. On April 19, 2011, staff had received nine Statement of Qualifications and on May 24, 2011 staff interviewed the top three most qualified consultants.  CDM was selected to provide professional engineering services to complete the groundwater monitoring and reporting for the Fresno Sanitary Landfill. CDM has both the previous experience with our current Landfill but also the personal relationships with the EPA which are critical to the Landfill project's success.  This agreement is the first year of a possible three year contract for testing at the Fresno Sanitary Landfill.
 
On September 29, 2011, Council approved an agreement with CDM for the first year of testing at the City Sanitary Landfill with the possibility of two one-year extensions. On December 20, 2012, Council awarded the second year of testing. On December 19, 2013, council awarded a third year of testing.  Staff is now bringing back the last extension of the original agreement. The cost for this contract is approximately $7,000 lower than previous years. This is due to reductions in Oversight of decommissioned wells at the Landfill that are inoperable due to the declining water levels in the aquifer.
 
Staff is requesting Council approve the third and final Amendment to Agreement with CDM Smith in the amount of $265,600 for the fourth year of testing and allow the Director of Public utilities or his designee to sign on behalf of the City.
 
ENVIRONMENTAL FINDINGS
 
By the definition provided in the California Environmental Quality Act Guidelines Section 15378 the award of this contract does not qualify as a "project" for the purposes of the California Environmental Quality Act.
 
LOCAL PREFERENCE
 
Local preference was not implemented because the amendment of an agreement does not include a competitive bidding.
 
FISCAL IMPACT
 
The cost of this agreement is fully funded by the Landfill Enterprise Fund.
