RECOMMENDATIONS
 
Staff recommends that the City Council adopt the 28th Amendment to the Annual Appropriation Resolution (AAR) No. 2014-95 to appropriate $350,000 to reimburse The McCaffrey Group for construction of a trail on the north side of Herndon between Hayes Avenue and Lola Avenue.  
 
EXECUTIVE SUMMARY
 
The McCaffrey Group has completed construction of a new trail along Herndon Avenue between Hayes and Lola Avenue.  The total cost was $274,051 for landscaping, irrigation, concrete surfacing, and an ornamental fence.  McCaffrey is also planning to build the trail west of Hayes for an additional 600 feet.  Funds for the additional section of trail are being appropriated at this time because the improvements are scheduled to be completed before the end of the budget year.  McCaffrey will not be paid until the work is completed.  The Resolution also includes $1,800 for staff time and $2,600 for overhead to process the reimbursement agreements.  Any funds not used will be allocated in a future budget for trail construction.
 
BACKGROUND
 
The 2025 General Plan Circulation Element classifies Herndon Avenue as an Expressway that has a bike and pedestrian trail.  The McCaffrey Group is building homes on the north side of Herndon near Hayes Avenue and agreed to construct the trail improvements.  The work included a 12-foot wide concrete trail, landscaping, irrigation, and an ornamental iron fence between the trail and Herndon Avenue.
 
The trail maintenance will be funded by Community Facilities District No. 11.
 
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section
15378 this item does not qualify as a "project" as defined by CEQA
      
LOCAL PREFERENCE
 
Not applicable because this is not a competitive bid.  McCaffrey used local contractors to complete the trail construction.
 
FISCAL IMPACT
 
Approval of the attached agreement will have no impact on the General Fund.  All costs are being allocated from Measure C Bicycle and Trail funds.
