RECOMMENDATION

 

Staff recommends City Council authorize the Chief of Police or designee to enter a First Amendment to the Service Agreement with the County of Fresno acknowledging annual budget approval, which included continued funding for the reimbursement of five Fresno Police Officers, one Police Sergeant, and one Crime Analyst, which will be assigned to the Adult Compliance Team (ACT)/ Multi-Agency Gang Enforcement Consortium Team (MAGEC) in an amount not to exceed $1,992,584 for Fiscal Year 2025-26 for a total compensation paid for all services performed for the first and second year of this Agreement not to exceed $3,932,659; and adopt the 25th Amendment to the Annual Appropriation Resolution No. 2025-179 appropriating $441,100. This amount will vary for year three as it is dependent upon contractual agreements with the various bargaining groups.

 

EXECUTIVE SUMMARY

 

One of the consequences of Assembly Bill 109, the Public Safety Realignment Act of 2011 (AB109), was the shifting of responsibility for supervising convicted criminals released from state prison facilities to county probation departments.  To accomplish this, funding was allocated from the State of California to the 58 counties through the Community Corrections Partnership (CCP) Boards established in each county.  The Fresno County CCP established an Adult Compliance Team (ACT) to ensure that convicted criminals are closely supervised after release.  A Fresno Police Officer has been part of the ACT Team since its inception in October 2011.

 

In January 2016, the City of Fresno and the County of Fresno entered into an agreement to continue the assignment of the one Fresno police officer to fulfill the responsibilities of the ACT member as set forth by AB109 through June 2016.  In November 2016, the City of Fresno and the County of Fresno amended the original agreement adding two additional police officers and one sergeant in the ACT Team.  The City of Fresno and the County of Fresno entered into a Third amendment to the original agreement, which included the addition of four Police Officers and one Crime Analyst assigned to the Multi-Agency Gang Enforcement Consortium (MAGEC) Team.

 

The City of Fresno and the County of Fresno now desire to enter into an Amendment No. 1 Agreement exercising the first year (or Year 2) of two one-year extensions to continue funding five Fresno Police Officers, one Police Sergeant, and one Crime Analyst plus equipment which costs shall not exceed $1,992,584 for Fiscal Year 2025-26, which will continue to be assigned to the ACT and MAGEC Teams. CCP monies shall be used solely to support ACT/MAGEC operations and personnel needs.

 

The Agreement requires annual budget approval from the Community Corrections Partnership (CCP) Executive Committee and the Fresno County Board of Supervisors (“Board”). Upon approval, an amendment to the Agreement must be executed to update the funding amount. As such, on June 9, 2025, the CCP Executive Committee approved the Fiscal Year (FY) 2025-26 AB 109 budget, which included continued funding for the City’s participation in the ACT and MAGEC. On September 15, 2025, the Board approved the Department’s budget which included this allocation. The County and the City must now enter into this First Amendment to reflect the FY 2025-26 approved budget for the City’s continued participation in the ACT and the MAGEC. This amount will vary for year three as it is dependent upon contractual agreements with the various bargaining groups.

 

BACKGROUND

 

A Fresno Police Officer has been a part of the ACT Team since its inception in October 2011.  On January 26, 2016, the City of Fresno and the County of Fresno entered into an Agreement (16-030) to assign one Police Officer to the ACT Team for FY 2015-16.  A First Amendment to Agreement was entered into in June 2016 for funding of overtime and extending Agreement 16-030 for one Police Officer for FY 2016-17.  A Second Amendment to Agreement 16-030 was executed in January 2017 to cover the assignment of two additional Police Officers and one Sergeant to the ACT Team for FY2016-17.  The Agreement and First and Second Amendment to Agreement resulted in a total of three Officers and one Sergeant being assigned to the ACT Team.

 

In December 2017, a Third Amendment to Agreement 16-030 was entered into extending it to Fiscal 2017-18 and adding four Police Officers and one Crime Analyst to the Multi-Agency Gang Enforcement Consortium (MAGEC) task force.

 

The Agreement and Amendments totaled seven Police Officers, one Sergeant and One Crime Analyst assigned to the ACT Team and MAGEC.

 

An elimination of one Police Officer from the ACT Team and one from MAGEC occurred due to a loss of revenue in AB 109 funding resulting in the Fiscal Year 2020-21 funding only five Police Officers, one Police Sergeant and one Crime Analyst to be responsible for fulfilling the responsibilities of an ACT member, in accordance with the ACT Operating Agreement.

LOCAL PREFERENCE

 

Local Preference was not considered because accepting funding from the State does not include a bid or award of a construction or services contract.

 

FISCAL IMPACT

 

The Police Department’s FY 2026 budget has $1,551,400 appropriated for part of this agreement and the attached AAR for $441,100 adds appropriations to fully fund five Fresno Police Officers, one Police Sergeant and one Crime Analyst plus equipment and vehicles.  All costs will be reimbursed by the County of Fresno. The total cost of the program will not exceed $1,992,584 in FY 26.  There will be no impact to the General Fund.
