Title
Approve First Amendment to Consultant Services Agreement with SWCA Environmental Consultant for environmental consulting services for the Community Development Division’s U.S. Department of Housing and Urban Development-funded projects, programs, and activities. The Amendment extends the Agreement from July 1, 2024, to July 1, 2025.

Staff recommends City Council approve the First Amendment to Consultant Services Agreement (Exhibit A - Amendment No. I to Consultant Services Agreement) with SWCA Environmental Consultants for 2024-2025 environmental consulting services for U.S. Department of Housing and Urban Development (HUD)-funded projects, programs, and activities.
EXECUTIVE SUMMARY
On August 11, 2022, the City Council approved a two-year Consultant Services Agreement with SWCA Environmental Consultants (Exhibit B - SWCA Consultant Services Agreement) to perform on-demand environmental review services for HUD-Funded projects, programs, and activities which expires on July 1, 2024. The Community Development Division would like to extend the services date for one-year from July 1, 2024, to July 1, 2025. There are no other modifications to the original August 11, 2022, Agreement.
BACKGROUND
The Community Development Division routinely uses environmental assessment consultants to perform on-demand services for the Community Development Division’s HUD-funded projects, programs, and activities. These projects, programs, and activities are funded with one or more of the following: Community Development Block Grant Program, Community Development Block Grant-CV Program, HOME Investment Partnerships Program, HOME-American Rescue Plan Program, Emergency Shelter Grants Program, Emergency Shelter Grants-CV, and U.S. Department of the Treasury, State and Local Fiscal Recovery Funds. Completion of the National Environmental Policy Act (NEPA) environmental review is mandatory for all federally funded projects, programs, and activities.
Since the original August 11, 2022, Consultant Services Agreement has an estimated $127,000 remaining on the contract, the Community Development Division is requesting a one-year extension from July 1, 2024, to July 1, 2025, to continue services and expend the remaining funds. There are no other modifications to the original August 11, 2022, Consultant Services Agreement.
ENVIRONMENTAL FINDINGS
On June 30, 2022, the Community Development Division completed a NEPA for the environmental consultant services contract which was determined under 24 CFR Part 58.34: Environmental and Other Studies, to be an exempt activity. This amendment is not a project as defined by the California Environmental Quality Act.
LOCAL PREFERENCE
Local preference was not used on the original agreement based on conditions of federal funding.
FISCAL IMPACT
The original agreement was funded with federal grant funds that were appropriated in the Planning and Development Department’s FY 2022 budget. The first amendment does not change the funding amount so there is no impact on the Planning and Development Department’s FY 2025 Budget.
