Approve Contract Change Order No. 03 with Avison Construction extending the date of completion to May 1, 2023 for the Shields Bankside Trail Project ID PW00725 (Council District 7)

RECOMMENDATION
Staff recommends that City Council approve Contract Change Order No. 03 in the amount of $0.00 on behalf of the City of Fresno to Avison Construction to increase Contract Time by forty-five (45) working days.
EXECUTIVE SUMMARY
The purpose of the change order is to allow the Contractor forty-five additional working days due to delays with PG&E pole relocations, a new water service connection that had not been identified on the construction drawings, and extensive irrigation wire theft that occurred during construction, delaying the Contractor from completing the project. The change order involves additional time but no additional cost to the City.
BACKGROUND
On September 1, 2016, the City Council approved the funding agreement to allow Measure “C” funding to be used for the design and construction of the Midtown Trail (then referred to as the “Metro Trail”). The Midtown Trail was split into five segments to be designed and constructed as stand-alone projects.
The Shields Avenue Bankside Trail Project, Shields Avenue from First Street to Fresno Street, is Segment 2 of the Midtown Trail program, a planned 7 mile pedestrian and cycle multipurpose trail, which will ultimately provide connectivity between the Fresno Area Express hub at Manchester Center and the Clovis Old Town Trail. The planned corridor will follow the Herndon Canal alignment along Shields Avenue, from Shields Avenue and First Street to McKinley Avenue, then along the Mill Creek alignment south of McKinley Avenue to Clovis Avenue, then northerly along Clovis Avenue to Shields Avenue. Segments 2 and 5 were the first two segments of the Midtown Trail to enter construction.
Contract Change Order No. 03 will add forty-five (45) working days to the Contract Time with no change to the contract price and will result in a revised contract completion date of May 1, 2023.
During the design phase of the project, it was determined that PG&E owned several power poles and associated anchorage points which conflict with the construction of a necessary soil retaining wall along the south bank of the Fresno Irrigation District Canal. These poles were scheduled to be relocated prior to the start of the project. PG&E repeatedly rescheduled this work thus causing a delay in the construction of this retaining wall and completion of the project. In addition to the utility delay, it was determined that the construction drawings lacked a service connection from the city water system to provide irrigation to trail landscaping. In addition, wire theft for trail irrigation caused unforeseen delays in installation and completion of the landscaping for the trail.
ENVIRONMENTAL FINDINGS
On December 10, 2020, City Council adopted Amended and Restated Environmental Assessment No. P20-01778, a determination that the proposed project for the Midtown Trail qualifies for the streamlined analysis set forth in the California Environmental Quality Act (CEQA) Guidelines Section 15183 (Projects Consistent with a Community Plan, General Plan, or Zoning) and dated December 10, 2020. A Notice of Exemption (NOE) was filed with the Fresno County Clerk on December 16, 2020
LOCAL PREFERENCE
Local preference was not implemented based on the conditions of the federal CMAQ grant.
FISCAL IMPACT
There will be no impact to the General Fund by extending the contract completion date at no cost to the City.
