RECOMMENDATION

 

Staff recommends Council approve the First Amendment to the Consultant Agreement with Borrelli and Associates, Inc. expanding services by $24,300 to revise the emergency back-up generation system for a total revised contract amount of $214,100 for the Municipal Service Center (MSC) Electrical Infrastructure and Rehab project and authorize the General Servies Director or designee to execute all related documents.

 

EXECUTIVE SUMMARY

 

On July 23, 2023, Council approved a construction contract with A-C Electric Company to implement the Municipal Service Center (MSC) Electrical Infrastructure and Rehab project. A major component of the project is replacement of the MSC campus generator. The Contractor is proposing a substitute generator manufacturer as the specified manufacturer cannot meet the technical requirements in the construction specifications. Whereas the proposed substitute will meet the construction specifications. The City has accepted the proposed substitution which will require the Engineer of Record, Borelli and Associates, to redesign the electrical plans and resubmit to the City for permit approval. The construction contract requires the contractor to be responsible for all costs to modify construction plans for substitute equipment. Therefore, the total cost to revise the plans from Borelli and Associates will be directly offset by a deductive change order to the construction contract with A-C Electric Company for a net zero change to the project.

 

In addition, the change in generator equipment manufacturers will result in additional credits to the City. The total deductive change order to the construction contract with A-C Electric Company, inclusive of both Borelli and Associates engineering fees and generator substitution, will result in a reduction of approximately $162,300.

 

BACKGROUND

 

Located at 2101 ‘G’ Street, the MSC sits on approximately 27.11 acres, has 26 buildings or canopy structures within its campus. The MSC is home to many core City services. These services include Fleet Maintenance, Facilities Management, Traffic Operations Center, Street Maintenance, Solid Waste Management, 911 backup center, LNG fuel station, unleaded fuel station, and houses critical citywide communication infrastructure.

 

The MSC electrical infrastructure is original to the MSC build out in the 1970s. The main switchboards are well past their useful life and parts are no longer available, making repairs difficult. The MSC is currently fed by a 4000 Amp service from PG&E and has an emergency backup generator. The emergency generator provides very limited power to the MSC and is not reliable due to the age of the infrastructure and generator.

 

In October 2020, Council approved an agreement with Borrelli and Associates, Inc. in the amount of

$177,800 plus a contingency of $12,000 for the design and preparation of construction documents for the project. In July 2023, Council awarded a construction contract to A-C Electric Company in the amount of $10,147,090 to implement the project. The project is currently under construction and a substitution of equipment is requiring the plans to be updated and submitted to the City for permit approval.

 

The specified generator manufacturer cannot meet the technical requirements of the construction plans and specifications. Therefore, the Contractor is proposing a substitute generator manufacturer which meets the technical requirements.

 

The substitution will require the Engineer of Record, Borelli and Associates, to redesign the electrical drawings and resubmit to the City building department for permit approval. The construction contract requires the contractor to be responsible for all costs to modify plans for substitute equipment. The total cost to revise the plans is $25,000.  The City shall utilize the remaining contingency funds of $700, plus an additional $24,300 in compensation to increase the contract to a revised value of $214,100.  The total cost to revise the plans from Borelli and Associates will be directly offset by a deductive change order to the construction contract with A-C Electric Company for a net zero change to the project. 

 

In addition, the change in generator equipment manufacturers will result in additional credits to the City. The total deductive change order to the construction contract with A-C Electric Company, inclusive of both Borelli and Associates engineering fees and generator substitution, is a reduction of approximately $162,300.

 

This First Amendment to Agreement has been approved as to form by the City Attorney’s Office.

 

ENVIRONMENTAL FINDINGS

 

This is not a project as defined by the California Environmental Quality Act (CEQA), pursuant to CEQA guidelines § 15378.

 

LOCAL PREFERENCE

 

Borrelli and Associates Inc., is a local business, as defined by the Fresno Municipal Code.

 

FISCAL IMPACT

 

The Facilities Management Division will utilize existing funds within the Division’s Repair and Replacement Projects fund. The additional cost will be offset by deductive change orders to the construction contract in the amount of approximately $162,300.
