RECOMMENDATIONS

 

Staff recommends that Council adopt a finding of Categorical Exemption and award a construction contract with American Paving Co. for $782,282 for the Melody Park Splash Pad project and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

Construction of a splash pad at Melody Park was approved for funding through the adopted FY2020 budget. There are no splash pad amenities available to the community in this part of Fresno, near Fowler and Shields Avenues. Melody is a well-attended park and the proposed splash play area will be a welcome addition for families during the summer heat. 

 

BACKGROUND

 

The City of Fresno Parks, After School, Recreation and Community Services (PARCS) Department wishes to build a splash pad within the existing Melody Park property.  Melody Park is a well-attended park and the proposed splash pad will be a welcome addition to provide the surrounding neighborhood children relief from the summer heat, while providing family fun in a safe location.

 

Pursuant to AO 6-19 staff prepared and entered into an agreement for consultant services on behalf of the City of Fresno for the design and preparation of construction documents for the Melody Park Splash Pad.  Plans and specifications were prepared by Provost & Pritchard Inc  A Notice Inviting Bids was published on December 13, 2019, distributed to thirteen building exchanges and posted on the City’s website.  The specifications were distributed to five prospective bidders.  Three sealed bid proposals were received and opened in a public bid opening on January 28, 2020, with bid amounts ranging from $782,282 to $900,000.

 

Staff is recommending that Council adopt finding of a Categorical Exemption and award of the construction contract to American Paving Co., of Fresno, CA, for $782,282 for the Melody Park Splash Pad and to authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno. 

 

ENVIRONMENTAL FINDINGS

 

Staff has determined that a Categorical Exemption is appropriate, based on Class 1 Section 15301(e) of the CEQA Guidelines, which exempts projects consisting of the operation, permitting, or minor alteration of existing public facilities (including additions to existing structures) that involve negligible or no expansion of use beyond that existing at the time of the lead agency’s determination.  Also, Class 3 Section 15303 wherein projects consisting of the construction and location of limited numbers of new, small facilities or structures.  Furthermore, staff has determined that note of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.  Staff recommends that the Council, based upon its own independent judgment, adopt a finding of a Categorical Exemption per Staff determination, pursuant to Sections 15301(e)/Class 1 and 15303/Class 3 of the CEQA Guidelines for the Melody Park Splash Pad Project.

 

LOCAL PREFERENCE

 

Local preference was not implemented because the lowest responsive and responsible bidder is a local business.

 

FISCAL IMPACT

 

The Melody Park Splash Pad project was included in the approved FY18, FY19, and FY20 PARCS capital budget.
