RECOMMENDATION

 

It is recommended Council approve the introduction of the ordinance, adding subsection (d) to Section 3-277 of the Fresno Municipal Code.

 

EXECUTIVE SUMMARY

 

The City desires to clarify the time limit of City Service for Council Assistants to avoid any overlap with a successor Councilmember’s staff.

 

BACKGROUND

 

Due to a lack of clarification in the Charter of the City of Fresno and the Fresno Municipal Code, there is the potential for a former Councilmember’s Council Assistant to remain on staff (i.e., in City service) and continue to receive City pay and benefits from the first Tuesday following the first Monday in January when a successor Councilmember officially assumes office, through the first Thursday following the first Monday in January when a former Councilmember ceremonially leaves office at a regularly-scheduled City Council meeting.

 

This ordinance is necessary to avoid any potential overlap between City service of Council Assistants. Additionally, the ordinance separates a Council Assistant from City service upon the assumption of office by a successor Councilmember when there is a Councilmember vacancy (i.e., pursuant to Article III, Section 305 of the Charter of the City of Fresno).

 

The City Attorney’s Office has reviewed and approved the proposed ordinance as to form.
